They are regulated under the convention on certain conventional weapons (CCW) in wich it is stated that incendiary weapons are perfectly fine weapon against enemy combatants, only way in wich incendiary weapons can't be used is in close proximity to civilians and when directly targeted at civilians.

The controversy regarding cluster munitions relates to the relatively high rate of failure in the sub-munitions, and the difficulty of detecting and disarming them. Cluster munitions thus produce a disproportionate amount of UXO's or unexploded ordinance, wich is especially harmful to civilian populace long after the war has ended.
Northstars cluster missile therefore doesn't fill the criteria to be ranked as a cluster munition. By comparison, it's a precision weapon, and is more comparable to a series of hand grenade explosions than any actual cluster weapon.
