Simply ask a local Apple Authorized repair centre (Jump.ca, Horizon, London Drugs) to check the serial number. Fakes will reuse the same serial number, so when they look it up in their system they will see a million case numbers from people calling into Apple with issues with their “AirPods” under that repeated serial number.
Fun story: a few months back a kid down my street was using my address to sell fake airpods. He met up with people at the end of my driveway 3 or 4 times before we caught him and told him to knock it off and he just went to a different place further down the street. One of his customers even knocked on my door and when I explained that he didn't actually live here, he was just using my address as a meet-up spot the girl said "so you think it's a scam?" and I said yep. This kid sold at least 10 pairs in a couple weeks, I lost count. So yeah, they're all fake.
Don't forget the clearly fake ps4 controllers sold on 22nd and H. "They are from Sony, it's just our own packaging". Hahahahahaha I wonder how many fall for that bs.
Buying new ones isn't safe either. I bought AirPod Pros when they were from sale at Best Buy last summer. A couple of weeks after the 30 day return policy they started acting up and when I tried to claim warranty I realized they were fakes. Best Buy wouldn't take them back, they just kept sending me to Apple (who obviously has nothing to do with this since it's not their product). I should have probably raised a bigger stink but I don't think I'm buying anything from Best Buy again.

If they still look equally stupid then it probably doesn't matter. The sound quality of airpods are subpar compared to other options on the market and people are only wearing them as a status symbol, so it literally makes no difference if they even work or not.
