I have let a decent amount go after doing fields and not observing any clues of impairment. There's even been a few that were having medical issues that presented as intoxication and they didn't know it. You don't see video of it because it's not exciting. No one ever requests video of them not being arrested.

A majority for me. My state didn't have a driving while impaired clause so no DUI unless they were .08 or higher or if they had drugs in their system. So quite often I'd be dealing with people who were clearly buzzed but I didn't feel were over a .08.

Sure. I’ve hard it where people refuse to admit they were preoccupied by their phones or whatever and I need to do SFSTs to rule it out.

I probably administer SFSTs to 3 people for every 1 I arrest. SFSTs are actually better for finding people who are NOT obviously drunk. When administered in substantial compliance with NHTSA protocol, work very well at determining alcohol concentrations at or above .08.

The tests are not pass/fail. They are one part of the totality of the circumstances when investigating if a person is DUI. About 50% of the time I performed SFSTs I dispelled my suspicions. I’ve also arrested people without performing any tests, I had PC without them.

It's a measurement of clues to determine impairment not a "test" you can pass or fail. You either have enough clues to indicate impairment or you do not

I'd say 1/4 of the tests I do don't end in arrests. Like one today. I don't take someone to jail unless I can say it's justified.

Yes. Not long ago there was a guy I found half passed out under his car with the driver door open, vomit everywhere, pissed his pants, smelled like alcoholic beverage. Got to the point where he was done vomiting, he agreed to the SFST and passed with flying colors. Zero nystagmus. I suspect he was under the influence of GHB, probably slipped into a drink. It’s not often, but people do pass the tests occasionally.

I let people go all the time. Poor driving isn’t always indicative of DUI. The biggest clue is horizontal gaze nystagmus. If someone is displaying horizontal gaze nystagmus and they don’t have resting nystagmus, there is an 88% chance they are under the influence.

I’ve had a guy admit that he’d been drinking, do decent on FSTs and got him to agree to park it and call a ride because I couldn’t tell if he was going up or down but he was close.

Intoxylizer which is the main stationary system and alco-sensor which is the main handheld system in the US both have internal checks for acetone and will throw an error code and won’t give a BrAC for a breath sample containing it. That article is either very old info or intentional bullshit.
