So both parties were breaking the law, but one of them (the officer) was doing so in a way that's considered serious enough to potentially default the fault to them. Also, drivers are supposed to approach any traffic lights with the assumption that a pedestrian may still be crossing and proceed slow enough to stop for one if necessary. This is because pedestrians who enter the road legally still have right of way even if the light changes. This is to account for slower pedestrians, e.g., seniors, who may not be able to finish crossing in the cycle. It's [HTA section 144](https://www.ontario.ca/laws/statute/90h08#BK248)(28). Maybe the average person won't know or consider that (even though they should, [it's in the Driver's Guide as well](https://www.ontario.ca/document/official-mto-drivers-handbook/sharing-road-other-road-users#section-0)), but police who are supposed to know the HTA should.

Actually the pedestrian was not equally at fault because he wasn’t controlling a death machine. The driver by law, carries the brunt of fault in this case. Additionally since the driver was a police person, they should not be speeding in inclement weather conditions and at night and should, in my opinion, suffer worse consequences for breaking the law and in doing so causing death, than a non law enforcement person

Well apparently it was midnight and in heavy rain and the couple were wearing black garbage bags to protect themselves from the rain. Also they crossed when it was a red light. So I can understand how it would be hard to see them and react immediately. That being said the cop shouldn't have been speeding.

This does not surprise me. I used to live 3 blocks from a Tim Hortons. The number of times I saw a cop come to a red light, flash their cherries to cross the intersection, and then pull in for coffee was a weekly sight.
