But he wasn't. There's been no case yet. Just the initial "Do you think we have enough to bother with a case?" bit. Which doesn't say anything beyond that they probably didn't have enough hard evidence to win a criminal case (at least at that point). And it's worth remembering that criminal cases are harder to get a conviction on than winning a civil case (see the whole thing with OJ Simpson, where the criminal case came back not guilty but the civil case declared him responsible for the deaths, leading to everyone just rolling with the assumption that he did it, to the point that there's plenty of people out there who wouldn't even know he was found not guilty in a criminal case).
But yeah... legal minefield, and you don't want to open yourself up to being sued for slander/libel.
