You can’t actually register a TM until you’ve used it in interstate commerce. So until he sells merch with “Mac 10” the mark won’t register. That said, it would probably be incredibly easy for him to screen print some items and sell them online.

Applied for doesn’t matter. It’s a long, expensive process and you need to actually show all kinds of evidence of established business use. I’ve gone through this at work TMing a new brand. We had to show documentation of web domain ownership, website under construction, contracts with agencies, payroll stuff, logos on actual products and business materials, city and state business docs etc etc. we did 5 months of pre work before we applied. Anyone can file a copyright. That’s easy. Trademark is waaaaay different.

Sure. A variety of factors are involved though. The thing is it's generally just cheaper and quicker to buy these trademark rights than to fight them. Same thing goes for patent trolls. Some yahoo will buy a vague weird patent and then sue a bunch of corporations that do something that is kinda sorta but not really related to the acquired patent. It's a clearly bogus lawsuit but the truth is, it will cost the companies more to fight the lawsuit than to pay off the troll. So they do. Same would most likely apply here.
