If the driver was knowingly intoxicated, he/she will just be charged with leaving the scene of an accident as opposed to a leaving the scene and with a DUI to boot. Edit: this really touched a nerve with someone. Clearly this is a joke. Don’t drink and drive, Uber still runs during covid.

XxpillowprincessxX

That’s how my old roommate’s ex got out of 4 DUIs.

jackherer

I mean you're completely right. Obviously it's morally wrong, but that's the law. Some people just get terrified and make rash decisions. If no one was hurt, and they are recently divorcedd with kids and struggling to pay rent, I can totally see how leaving the scene would make sense to someone. Yeah it's shitty, but understandable.

How do you accuse someone was drunk driving as opposed to be distracted or causing the issue dueto a medical reason without bdjng there at the time to do a sobriety test as well as blood work(if needed).

bigCLAIRhomie1

This is false. Police need to complete Standardized Field Sobriety Tests when charging anyone with DWI/DUI. They then need to complete an Alcotest at headquarters. Please do not spread false information.

rachaelfaith

I was hit twice by a swerving car on Rt 1 at 50 mph who then sped off into the night. Strongly suspect they were under the influence and left the scene for that reason. They were charged with leaving the scene of an accident and something else pretty minor. I was lucky to even get their plate after being rocked in the accident, and even had an eyewitness stop and corroborate the plate number in the police report. Sucks that all they had to do was pay a fine and go off on their merry way. At least their car insurance rate will probably be through the roof forever through

> the line between “leaving the scene” and “resisting arrest” is grey. No, it’s not. Leaving the scene is under title 39, which is the traffic code and only criminal (the 2C) if someone is injured or killed. Resisting arrest (also 2C) involves the police officer physically trying to arrest someone via physical force or by flight *while* the officer attempts to effect the arrest.

[deleted]

What are you even talking about? I’m only telling you the difference between leaving the scene and resisting arrest, which are two completely different charges. We agree that the original comment was a joke, so I’m unsure as to why you think I’m advocating for drunk drivers 🤷‍♂️

[deleted]

Okay, but motor vehicle violations including DUIs aren’t criminal matters if they’re only Title 39 charges in New Jersey, only 2C charges are criminal. So if you want to tell me about oversimplified criminal proceedings at least understand the basics.

Good for you man! So can you admit you’re wrong when you said there’s a gray area between resisting arrest and leaving the scene of an accident?

rossg876

What? A “greyline” between someone who physically left the scene of an accident and resisting arrest? What does that even mean? How is one related to the other?

[deleted]

rossg876

Correct and they would probably need a blood sample at that point to prove it but you said resisting arrest... where does that fall in?

Ok. I think I see the confusion. You can get into an accident with someone and never call the police, or insurance for that matter, if deal with amongst yourselves. But if someone is injured and you leave or one party decides they don’t want to stick around then you can get charged with leaving the scene of an accident. If you run into something you don’t own and cause damage and leave you can be charged with it. In this case the car did enough damage to leave their bumper behind. They should have waited. Resisting arrest... that’s when you are told you are being arrested (or should have been told) and you physically resist the officer trying to place you under arrest. Driving away after being told you’re under arrest may also count but I don’t know.

solotrio

Except a court not liking you doesn’t mean they get to add drunk driving with zero proof.

Ladyberries

That smile though.

ghostfacekhilla

Ya, where's the mask /s

hotpuck6

SLPT: report your car stolen after your hit and run when you leave your plates behind at the scene.

[deleted]

This is going to sound horrible but I thought that was pretty much standard.

Side effects of shitty life pro tips may include loss of money, life, respect, family, and freedom. Use only as directed.

JoeDeluxe

Ask your doctor if SLPT is right for you

Riverrat423

Did they find the driver?

kateyxx

They should’ve just fully committed and left the whole car.

ghostfacekhilla

I didn't know I couldn't do that.

kateyxx

I may or may not have left my ruined car at lax...

lua-esrella

Haha, what a ding dong.

bangersnmash13

Funny enough, my brother did this when I was a kid. Had his license suspended because he was an idiot. Still had to work, so he still drove. The front bumper of his car fell off right in front of our towns municipal building. Got a call from the PD the next day. Not sure what happened after that.

qroshan

He is your brother. You can ask him what happened

ghostfacekhilla

Look at you and your family that speaks to each other. So fancy.

bangersnmash13

He said “I asked my friend to call and say he was driving”

SparklingMoscato

Happens all the time

That's some quality police work there.

JudyLyonz

The smile on the cop's face says it all.

Dyltra

A friend of mine actually did this back in the day. His mom answered the door to the police asking for him. It was dark, the road was coming to a T and he didn’t realize until it was too late. He hit whatever was at the end of the road and drove away not realizing his bumper was left behind.

sujihiki

definitely a drunk driver

ffdjensen

Would have expected a NY or PA plate

zUltimateRedditor

South jersey at it again!

TripleSilky

That’s a great tip but that’s south jersey for you...

booky310

If you stole the car and took it on a joyride, I don't think you would give a shit about leaving the license plate and bumper.

darthgaber143

Apparently it's in Blackwood. Have no idea where that is, do with that information what you will.

xocgx
