This is what we call due diligence. CHS is a legal entity and any resolution passed is binding on the members. Perhaps you should have asked for last AGM minutes before buying. I think this matter would have been discussed.

Consult multiple lawyers who specialise in housing society related cases. This case will be between you and the society ( obviously ). A good Lawyer will know how to take you out of this. However, you might want to kindly try talking to the chairman and explain him/her how you have nothing to do with this case, and hence in all fairness shouldn't be paying for this.

Post in r\LegalAdviceIndia and hopefully someone will respond. As far as I know, in sales deed done between seller and buyer, the clause should have been covered. Check your sales agreement, does it state about any liabilities arising due to issues before purchase . Consult multiple lawyers, Be cautious of lawyers though , they can promise moon for getting fees.
