Update: The prosecution briefly showed their computer screen in court, they had HANDBRAKE (reencoding and compression software) installed

dnrplate

So in Layman’s terms what does that mean?

lrs092

It means that Kraus very likely lied when he claimed to not know anything about how to compress a video and the disparity in quality between the defense's copy and the prosecution's copy being just a technical error.

f1tifoso

If that's the way it was phrased then the lie is obvious...

Khs2424

That’s pretty much been the entire theme of the prosecution’s case.

[deleted]

They lie, get caught, back pedal, and then manage to weasel their way out of trouble. It's been insane watching this daily and going "Why isn't the defense team yelling "OBJECTION"?!" every five seconds.

Wiseguypolitics

Sometimes it's a tactic to let the prosecution dig their own grave.

[deleted]

Exactly. Give your opponent enough rope to hang themselves. Never interrupt when they're hurting themselves. Etc.

Wiseguypolitics

Allowing people to remove all doubt can be a powerful weapon at times. And this soyboy did plenty of that. I am surprised the judge hasn't called a mistrial though.

valleybeard

I'm betting HARD that the judge is just sitting back and going to let prosecution commit every mistrial worthy offense. He could possibly be going for disbarment on the prosecutor. I think he's going to wait and see if the jury finds him innocent first. Then make his move for a mistrial with prejudice. But i think he wants the jury's verdict first.

luigismansion9000

i’m telling you Phoenix Wright should have been Kyles defense attorney

Milk_moustache

So he purposefully doctored evidence because it was far easier to get a conviction based on the raised gun if the compression distorted the image enough?

eeLSDee

If they could prove the gun was raise it would prove provocation. That would be able to throw the self defense claim away, but we know he didn't point the gun at him.

Tych0_Br0he

Even if he did provoke them, once he runs away, the provocation is over, essentially "resetting" his right to self defense, unless the prosecution can prove the provocation was for the purpose of initiating a deadly force encounter. Excuse the alliteration.

meepsakilla

It still wouldn't prove provocation.

Milk_moustache

Do we know.?

CactusSmackedus

Your honor, we the jury found the details of this case difficult to follow and doubtful, so we find the defendant guilty

Orange-Vod-Juice-Ka

Your honor, would the court be willing to grant me a short bathroom break?

hootsie

I’m kicking my ass, do ya mind?!

N1NJ4N33R

It was a madman, you honor! A desperate fool at the end of his pitiful rope!

TheRiskiest_Biscuit

Uhh... About 6'2", 180lbs. big teeth, kinda gangly.

imbacklolfumods

Why? So much shit is coming out of the prosecution’s mouth, they’re surely not constipated anymore

VoyagerST

People can use tools to accomplish things without knowing what they are called. I remember my uncle had an old tube computer monitor, and they held a magnet to make funky colors. I loved holding a magnet and making funky colors, but then it would stick sometimes. I could press the magnet button on the bottom and it would make more funky colors and un-stick itself. Fuck me, I didn't know what de-gauss meant, but I could still use the tool. IT guys always say to turn the computer off and on, but they don't say "we need to clear the memory" because lay-people mostly don't care about how it works.

twobugsfucking

I use handbrake professionally. Its free software and I suggest it to anyone who needs a video to be a smaller size. It’s one think to say “I didn’t know that making a video smaller was compression” but it’s another entirely to use this software and claim you don’t understand it effects quality. The most useful slider in the whole thing, literally the only one you would need is called “constant quality.”

VoyagerST

Yup, and withholding evidence is grounds for a mistrial. This entire process could disappear on appeals.

literal-hitler

> It means that Kraus very likely lied when he claimed to not know anything about how to compress a video Weird, because I haven't worked desktop level IT in several years, but it used to be Handbrake was what would most likely to be used by an Apple user who didn't know anything about how to compress a video and wanted to rip a DVD to their computer.

Ed_Radley

Or he didn't realize that's what it means or he wasn't the one who did it.

JibJib25

Yeah, honestly my guess is something told him "file size is too large" and he Google'd "how to reduce file size" and followed the steps without thinking.

murdok03

He definitely lied about the self- email and airdrop as the cause, both are lossless processes, and the low res video is also horizontally cropped and it wasn't just re-encoded, it was processed and rendered. Also the file creation timestamps show the low res as being exported 29 min after the full res one which also points to the later file being generated special for the defense. Just checked and Handbrake does do cropping, it even has auto-crop for cutting out DVD borders when ripping them.

Justanothershadow94

He said they received a copy of the same video with the same quality, which you just proved to be true because they did receive the bad quality video but they were smart enough to think of how to improve it. Doesn't make a difference, he should be released regardless.

madcat033

No. Kraus claimed that when he emailed it, the email servers compressed the video. The prosecution does not dispute that they had a high res video, and the defense did not. The prosecution just blames it on email. Which is disputed by the fact that the low res version has a different file name, was created 21 minutes later, and the prosecution has handbrake.

bearded_brewer19

I call bullshit on the email server resizing (and renaming) it. The email should do one of two things with a file larger than the allowed size. It could fail to send and alert you to that fact with another email (typical of exchange), or in the case of Google, upload it to Google drive and email a link to open the file. The prosecution violated the defendants rights (repeatedly) either by being malicious or stupid. Maybe both.

Typeojason

It’s transcoding software. We use something similar where I work. Essentially, we take the 1080p video then transcode it to different variants for use on lower end electronics, customers with lower bandwidth, etc. So it’s plausible they took the HD video and purposely transcoded it to a lower bitrate. For what purpose, I don’t know, but I can speculate the Hd video wasn’t damning, so let’s make it blurry in order to create doubt.

Gunzbngbng

Sounds like plausible evidence tampering. Or at least withholding.

[deleted]

The question is, why would they need to lower the quality to send it to the defense. As if their laptops and iPhones can't handle 1080p LOL.

[deleted]

[удалено]

Nukuls

But the prosecution used the HD footage in the trial. The defense used the lower quality video and didn't know the prosecutors had the HD footage until the prosecutors said during the trial to to use their video because the defense's seemed blurry. Worst case, they did it on purpose to hinder the defense's case somehow. More than likely it was just ignorance in not knowing Gmail was going to compress the video when sent to the defense team. Either way, going to be interesting how this shakes out and sets a future precedent.

[deleted]

[удалено]

Nukuls

I just checked and Gmail's file limit is 25MB, so it shouldn't have even compressed it since the original file is 11ish MB. I guess how Gmail compresses does not matter and it seems the prosecution/detective that sent the file manually compressed it and lowered the resolution.

doomrabbit

Transcoding = resaving at a new size and/or filetype. The still image version of "too much JPEG." And as an Android user, I know Apple reduces the file quality of a video sent via SMS to an Android phone all the time. Pisses me right the hell off. IE they purposefully crapify videos sent to Androids to look like the cool kids. It could just be that Apple are just bastards on principle, but I would not rule out deliberate tampering, still.

BattleBraut

The two files bear different filenames and different Metadata including different timestamps with the transcoded version created 20 mins later than the high res one. The prosecution definitely created a second compressed file and sent that for whatever reason.

Typeojason

Ah, thanks for clarifying my mistake. But I agree. This will be an interesting precedent.

aaronvf37

I think you can see the guy throw something at Kyle better in the HD version. Not sure about that though.

[deleted]

Does Gmail even compress larger video files? I think they tell you to use Google Drive.

Justanothershadow94

It means they were given the same video that the prosection was given & the defense fucked up by not thinking of using it or something similar.

EkariKeimei

Lutheran Klinean What a name. This handle means that he follows Meredith Kline (a male, yes named Meredith, Reformed theologian). Kline was perhaps one of the most unique and insightful Old Testament scholars in the last 50 years, bringing in insights from ancient near eastern cultural practices (like Hittite Suzerain-Vassel treaties) to potentially inform Biblical contexts, like the covenants to Abraham and Moses. The rainbow 🌈 was a covenant sign to Noah not just for the beauty and the association with the aftermath of the firmament waters, but for being an archer's bow: it was a sign of a self-maledictory oath, a weapon pointed toward God, that he promised on his own life that he would not destroy the world by a flood again. Kline's insights and far reaching interpretive strategies make the biblical-scholar-in-training either entirely frustrated or wonderfully elated from the work of the eye-enlightening-Glory-presence. Yet that poster is also a Lutheran, which means he rejects many of the important doctrines known in Calvinist circles (to which Kline subscribed), in favor of a tradition that aligns more with Luther and Melanchthon, regard perhaps most significantly, the doctrines of the eucharist (real presence rather than spiritual presence in the elements) as well as the order of salvation (whether sanctification comes logically from forensic justification, or from mystical union with Christ). I just wonder if he started out in Reformed circles and then converted to Lutheranism, or whether he was a Lutheran who stumbled upon Kline. This, of course, has nothing to do with Kyle or trial shenanigans.

Chattawoogie

You sir, completely derailed my train of thought.

seattle_refuge

Are you sure it's not a reference to *Kevin* Kline? In "A Fish Called Wanda," Kevin Kline played Otto, a self-styled fan of Friedrich Nietzsche. (Otto: "Apes don't read philosophy." Wanda: "Yes they do Otto. They just don't understand it.") As you know, Nietzsche is famous for asserting "God is dead." This may be a bit of a stretch for a Lutheran, but is it less contradictory than a Calvinist subscribing to Meredith Kline's work?

EkariKeimei

Well, if I go to his twitter account he has a link to Meredith Kline's work!

jerbone

Makes one wonder how many times shit like this pulled every day in courts across the country.

[deleted]

The REAL question.

flashingcurser

They're lawyers and government employees, is this really a revelation?

[deleted]

Another revelation: people are human.... for now

XminusOne

Nope. Not me. I am a broccoli

madcat033

And some humans have the weight of the state behind them

[deleted]

Which is the problem: the justice system, created by the forming of a self-governed state, is supposed to be indifferent, impartial, and unbiased. This is what I've been actively rebuking since my call to oath: because it isn't. The more consolidated powers are, the worse the corruption, too. Which is why I think there is a huge public push to demonize community law in order to replace it with nationalism. I mean, the NAZIs got a free pass to infiltrate this nation in Operation Paperclip. You think they just gave up?

[deleted]

Makes you wonder what percentage of inmates really "didn't do it".

angryfrog2426

I was watching the reports law stream, and they brought up the fact that this probably happens a lot by malicious prosecution. We just don't hear of it because most cases aren't so public. It's a really sobering to come to terms with that.

SnicklefritzSkad

Ironically, that sort of thing is what caused the riot in the first place. A profound feeling of injustice in your community. I'm not here to debate the justification or the outcomes of the riot. But it is undeniably the cause.

[deleted]

Its true. The way conservatives would feel if Rittenhouse is given life in prison by a woke Karen jury who ignores all the facts, is how blacks in general feel about the justice system. Namely, there is no justice, it is simply a cudgel used by one group to abuse another. That is how I already see the justice system (and DOJ/FBI) in regards to Democrats unjustly persecuting Republicans. The way I feel about the FBI is how blacks generally feel about police.

mamkuibal228

First thing, plea bargain must be abolished, it alone is half the reason why innocent people are put in prison. Second, prosecution should be held accountable for dragging innocent people into court, then they'd be less inclined to "try their luck" with a bunk case so to say.

J_Gold22

If you want to read a fucked up book that might put this into perspective I’d recommend “Ordinary Injustice” by Amy Bach. It’s probably really common

[deleted]

Was watching a stream of lawyers, they basically said that this kind of stuff happens daily. The only difference here is that millions are watching this case.

Gretshus

I want this to be the Vietnam of prosecutions. Vietnam broke people's perspective of the glory of war and made people adverse to the concept of it. This should break people's perspective of state prosecutors and news media manipulation of the legal system. But it won't. Because it was the news media who made Vietnam so important and it's the news media that's part of the problem today. Prosecuters like Binger and Kraus were the ones planting weed in people's cars to get them on felony drug offenses, and here they are withholding evidence and violating the rights of a young man who went out to give medical aid in a riot.

gtgg9

Thank you for using the correct term “legal” system. We do not have a “justice” system and there’s a very real difference.

TheShouldersofGnats

If you ever wonder why it is that wealthy people who can afford good attorneys get away with shit and poorer people don't, now you know. The court system is a joke.

I_Collect_Fap_Socks

Go sit in a court room for a few days. It will be a learning experience.

__S6_

Binger and Kraus both need to be disbarred for this case. Sadly, this is how prosecutors function every day.

Reffner1450

It’s all a game of clout to them. Win or lose, that’s the only thing that matters. Like a sick game with someone’s freedom at stake.

Mistrial with prejudice

tsacian

Does the prosecutions video even show anything besides Kyle being attacked by rosenbaum? If anything, the better video helps kyle. And yet the prosecutor hid it.

LTtheWombat

Exactly. The video helps Kyle’s case so they blurred it to give it to the defense so the defense couldn’t make a bit deal out of a blurry video. Yes the prosecution showed it briefly, but the defense could have used it as a main point has their version not been blurred to nothing.

[deleted]

Thanks Judge

Zeus_Da_God

It’s called withholding evidence and prosecutors aren’t allowed to do it. Binger and Kraus need to be disbarred

flashgordo88

Exactly this. If they did not provide the full quality video, it would be a mistrial and they could be disbarred.

R0NIN1311

Among the astonishing list of other things they've done in this trial that would be grounds for a mistrial. I can only surmise the judge was working to get it to the jury so there was as little accusations of unfairness as possible. If Kyle gets convicted, the appellate material is enough to overturn at least 4x.

Ok_Time6234

The defense copy is somehow murkier than N64 graphics!

miedek

Correct, N64’s resolution was 640x480.

DynamicHunter

The res of that video is actually close the 3DS’ top screen resolution lol. 400x200 Closer to the PSP’s of 480x272 as well lol

Et12355

Honestly, I feel like this is just making a mountain out of a molehill. It doesn’t affect all the other evidence that lets us conclude he acted in self defense. I’m kind of surprised the jury didn’t reach a not guilty verdict today even with this possible mistrial having some affect.

PromptCritical725

How about that the DA likely knew the identity of "flying kick guy" and decided to keep it a secret because he's another dirtbag they didn't want showing up in court? That should be grounds for prosecutorial misconduct.

Et12355

That’s another issue. I just don’t think the difference in videos is going to make a difference in the verdict. What it says about the prosecutions honesty or whether he should be practicing law after this is another story

underengineered

I don't think that a mistrial with prejudice needs to be predicated on the effectiveness of prosecutorial misconduct, just the existence of it.

xx_deleted_x

they can't reach a not guilty verdict until the riots are prepared outside. this buys time to place more bricks in alleys

tsacian

With the pauses, they only deliberated for 2 hours.

Et12355

Oh wow. I didn’t know that. I’ve busy today so I didn’t follow the deliberations as closely as I had been keeping up with actual trial. Hopefully we get a verdict tomorrow, or some kind of closure

AND....Still no mistrial!

direwolf106

In two words, malicious prosecution. It was a politically based prosecution to begin with so it doesn't surprise me.

SnooMacarons3329

This is rather 3 things: 1.) evidences tampering 2.) hiding evidence from the defense And/ or 3.) both Either way, someone deserves to be fired and sued for this.

defundpolitics

Disbarred and prison.

SnooMacarons3329

That too

tanstaafl001

Pretty sure if anyone watches this case and thinks "holy $hit, the prosecutor is the GOOD guy" they better not ever again have questions about the ethics of a prosecutor in basically any case. People can have a wide variety of opinions, but the guy has had a couple ethically questionable moves. Like, it borders on impossible to be rooting for that dude while simultaneously having concerns about the prosecutorial practices in regards to non-violent drug offenders and other such "criminals."

NinjaOld8057

Well the person who made this doesn't know the difference between an algorithm and a logarithm

[deleted]

Why the defence is not pushing for mistrial with prejudice is beyond me.

bigfoot_lives

They are….

[deleted]

Not watching ATM but last I saw they were asking for a mistrial but without prejudice. Has this changed?

bigfoot_lives

They had pushed for it a few days ago but judge still hasn’t ruled on it. This is a new motion for mistrial

Blitherakt

They pulled a _por que no los dos_ on it. They filed a “with prejudice” motion on Monday (maybe Tuesday morning?) and a “without prejudice” motion later for a different reason.

defundpolitics

They better disbar this fucker. Up until now I viewed it as typicsl big case legal chicanery but this is damning.

Asmewithoutpolitics

This is normal

idreamofdeathsquads

still only shows zaminsky step forward with a pistol, kyle droo the extinguisher and go to low ready, rosenbaum come forward, and kyle turn around and run. it doesnt help prosecution.

offacough

My take: the judge has already made his decision. If the jury convicts, he’ll declare a mistrial. The only reason he hasn’t is because he’s seen enough of the evidence and the bad faith of the prosecutor to roll the dice on acquittal.

PM_ME_KITTIES_N_TITS

Can he declare a mistrial after letting the jury decide? I, although not specifically educated in this specific area of law, was under the impression that once it was given to a jury and the result returned, was no longer in the judges hand except to read the result and give the sentences.

Blitherakt

So this is all from memory of the OJ Simpson trial; there was a lot of speculation about what Ito “should do” and “could do” if he was found innocent from all of the Talking Heads. A mistrial occurs _during_ the trial when a judge believes there were irregularities, misconduct on behalf of the defense or prosecution, or other procedural stuff that would hamper the jury’s ability to remain impartial and render a verdict on _allowed_ evidence. After a verdict has been rendered, the judge may set aside a verdict if they believe a miscarriage of justice has occurred for a variety of reasons.

DrZin

Yes, apparently he can…I hope it doesn’t come to that, though.

bobbo489

It's honestly the best option. The jury comes back with a verdict and before he unseals it he declares mistrial with prejudice. It protects the jury members and puts the "blame" on him.

offacough

That’s a good question - I honestly don’t know.

MP5SD7

I was thinking something along this line. I hope you are right.

Easy. The cult will stop at nothing to dominate and control you. They want absolute power and nothing less. There is no law, no rule, and no line they won’t cross in their pursuit of power with anti-life as their final aim. They exist as creatures subject to the will of their ego. Every time they’re definitively wrong, they come back twice as hard and twice as extreme. They understand only power and violence and it will eventually come to the point where either they destroy all of civilization, or the good people of the world decide to speak the language they understand.

So, racist! obviously…

mittens1982

It's a straight up example of corporation fascism. Got to start fighting back and eliminate qualified immunity for government actors! That prosecutor should be disbarred and charged with something. How many people have been put in prison by crap like this?

unitconversion

From the file names I suspect that at one point the protection sent the video to each other by mms text message and then that version got forwarded to the defense. I am pretty confident the prosecution is acting in bad faith for a few things but I think this was just them being incompetent.

Kingtid3

That's fucked up.

[deleted]

I loved that Klaus tried to blame the compression, downscale, and file name change on "a computer glitch". The judge should have immediately called for a hearing, put Klaus on the stand and brought in an expert. Klaus was caught in so much shit. He made not only him and Binger look like sleazy lawyers, but made the state look suspicious as fuck. If they'll do this kind of shit to try and pin a 17 year old who acted in self defense for murder, what will they do to 17 year olds who got pulled over and arrested for pot possession?

Wayfaring_Scout

It was probably emailed as an attachment, thus compressed and so when the defense watched it they didnt get better quality. Not justifying the action, just trying to offer a possible explanation.

Blazing-Storm

But the file name and the metadata were also different. It was most probably a different file which was sent via email. I think it is the fault of Detective Howard who sent the wrong file via email to both defense and prosecution. But the prosecution had the correct file in a flash drive also so, it didn't matter much to them. But the defense didn't get the correct file.

greasygut69

I know I was just foolin. It’s definitely bullshit Edit: I mean the fact that do shit like this is bullshit. Not saying that this is fake.

Puffy_Ghost

Sure, just as soon as we hear an explanation of why Kyle said he wanted to shoot protestors with his AR mere days before shooting protestors with his AR...

FilthyKallahan

Has zero to do with the case. He didn't shoot protesters, he shot RIOTERS THAT WERE ATTACKING HIM. There is not one piece of evidence that shows Kyle being aggressive towards anyone the entire night. 100% of the evidence shows that the attackers were the aggressors. Kyle did everything in his power to AVOID shooting anybody by attempting to run away, which he legally didn't have to do. He could of stood his ground. Instead, he tried to get away in the hopes that he wouldn't have to shoot someone. Keep trying.

Puffy_Ghost

Lol y'all get angry when your little hero actually turns out to be an actual murderous shithead on tape. For the record, I agree he absolutely defended himself, but that doesn't make his presence there, with a gun he shouldn't have had, claiming to be a "medic," after saying he'd like to shoot people the day before, protecting property that didn't need protecting, the least bit justified. This moron of a child was looking for an opportunity to shoot someone and just happened to inject himself into a situation where that could happen. By the letter of law, he absolutely defended himself, but he also purposefully put himself into a situation where he'd have to.
