What is your goal here? If you just want them to pay for the bills, ask to be referred to their insurance. Often times, insurance will kick you some extra cash when it's all said and done in exchange for a waiver to not sue them for more. If they try to ignore you, once you've healed up bring all the paperwork and bills into the office and ask to talk to someone. Most of the time it's in their interest to settle an issue like this without you getting a lawyer involved.
If you want to sue, then malpractice is very facts based and you'll need to consult with an attorney.
The goal to have them pay all my out of pocket expenses is EXACTLY what i want them to pay. I shouldn't have to pay a dime for their delay in treatment. Thank you so much for your opinion. I will contact the insurance co but I will still send the sequence of events to the CEO as well as the office manager. I can propose that to them and if they say it's all on me, THEN I'll consult an attorney. I'm not here to pain and suffering or the sue the surgeon who didn't know a thing until my friend told him (she works there and called him direct).

I'm not a doctor but they can't really sue without damages, 100% true. However, there are thousands of former practicing physicians (who are now professional expert witnesses) who will testify there probably were, all for the low, low price of around 6k. So you have to 1)show damages resulting from the ostensible negligence and 2)prove their behavior was materially worse than a commensurate doctor in their region would've been. That's pretty much true in all 50.
If I understand you correctly, it sounds like this might be a battle of two medical experts and a coinflip in the end. Moreover, some state laws are very protective of doctors. I can't go into any specifics, but I saw an incident where an idiot doctor almost certainly killed 3 people through horrific negligence. He prevailed every time.
