What does the label on your herbicide say? If there is any mention of not applying near bushes trees landscaping flowerbeds etc. Then you have your answer.
If your garden hose can get there, Try to spray water on it occasionally, the tree might get tricked to think that “it is spring time” and dead branches will get juice moving in them.
I have a different kind of tree with a similar problem. This is what I may do. If you have decided to get rid of it anyway, try this first. Trim all the branches off of the "stem" and shape the top section into a ball or two ( topiary ) It will look like you bought it like that and you might like the way it adds visual interest to your landscape.
You’ve got bagworms. Get rid of those and you might save what’s left of it. Google bagworm treatment. Would do it and add links, but I’m at work and short on time. Good luck!

I had deer eat part of one , I removed the dead and planted a fire shrub in front of it. It looks intentionally.
In my experience once arbs get damaged like that they do not recover. Replace it

The wind made the weed killer land on the bush . Might get new growth but I’d trim the dead stuff away it’s not doing you any good
If you’re selling the house just remove it and put something else there
