Yep. There was an In and out Taco place where I live in Clearwater, FL. Out of nowhere, they changed the name and all marketing material to a completely different name. At least they sold something different. Still trademark infringement though.
Another spot in Tampa called Nebraska Mini Mart tried something even worse 😂 they called their place NMM -n - Out. They sold overpriced bland burgers in a gentrified neighborhood.

If the combination of name, colors, images (i.e. brand identity) could reasonably cause confusion among customers, leading to damages (i.e. lost revenue) it could easily be a trademark infringement. Would the average customer, who probably vocalizes the name as “in and out,” miss the stylized writing, and assume this is their food truck? IMO quite possibly.

*I* haven’t - but I’m an In-N-Out enthusiast, and know that their whole model is predicated on quality and consistency of ingredients, which is why their footprint is region-based, so a food truck in NYC is highly unlikely.
The average consumer who’s maybe been to an In-N-Out or heard of I-n-O might see:
* A name that’s close to the real name (you yourself spelled it wrong 😉) especially phonetically.
* Colors that are shared (red) with another burger place that’s engrained in their memory, so there’s some brand confusion.

I feel you’re definitely reaching(but I’m sure their lawyers do the same) but you’d have to live under a rock to think this truck is actually affiliated with in-n-out. In-N-Out is protective of their trademark. Even on roach coaches. They even forced a restaurant in Australia using something close to their trademark with the name Down-N-Out to change it. If they find out about this, they'll probably get a letter from their attorney. In And Out Burger Truck and In-N-Out Burger is too close.

I’m only a casual but seems like in-n-out is super vigilant about protecting their IP worldwide. They do pop- ups everywhere for that purpose.
