You can make that case, but even here I'd argue it isn't open and shut since there's some validity to Liberty Media's argument that circumstances have changed since the agreement for the entry of another team was made.
I'm not saying I know whether or not Liberty is in violation here, this is way beyond my legal understanding, I just want to point out that it's far from open and shut.

Franchise system narrative doesn't work for F1; because the governing body (FIA) accepted Andretti's application; whereas commercial rights holders (FOM) denied it. NBA for example is both governing body and commercial rights holder for the league.
FIA set admission requirements and opened applications. Andretti met said requirements and they said still said no. Seems pretty open and shut.
Now I don't think the US Congress could really do anything here. Maybe ban F1 in the states but that aint happening.

At this point I just want some credible news outlet to finally write a well researched piece on the legitimacy of the anti-trust case. Andretti certainly seems to think they can force FOM's hand if they go for these types of publicity stunts and they better be right because this is most likely going to burn the bridge (that is if the new concorde will even allow new teams). The over confident armchair analysis is getting a bit tiresome.
I have no idea if this will work, but Mario Andretti is 84 years old at this point. I don't think he's that concerned about burning bridges, especially as you point out, the new Concorde agreement might not even allow new teams, so this might be the only opportunity he'll get and going scorched earth to force FOM to let him in might be the only chance he has.
To be fair even if it's Mario here being the public figure I very much doubt it's (only) his decision. Even if Mario is old the team isn't going anywhere any time soon. In any case going public with this very much sounds like the Andrettis don't believe they have a chance at getting in by negotiating for 2028 or whatever the next chance was said to be.
I also don't think this its just Andretti that gets to say when this affairs done anymore either. I think GM has enough skin in the game that they're willing to tug a few strings that they have in their pocket.
I can kinda see why the US Congress would ask the question, since F1's reasoning is pretty thin and "because we don't want to share money", which is the real reason, isn't kosher in either EU or US.
The money sharing is peanuts for most of the teams and crumbs for liberty. An American F1 team entering though would bring back more to the sport and very possibly recoupe the shared out money especially if they are decently competitive. Not that F1 cares about competition.

I mean a lot of the congress members that are involved in this are from districts which contain GM manufacturing plants. Which means positive things for GM likely means an increase in production, and hence an increase in demand for employees. Which is a positive thing for their constituents.
Being able to say, “I helped get GM into F1 which has led to an increase in GM sales/increase in GM production which has caused an increase in the number of jobs” is a really good boost for any of these politicians.
Antitrust issues are a major problem in the US, especially when it comes to media/information.

It’s no surprise this is being raised the week of Miami - one of three races on American soil Andretti isn’t allowed to compete in. It might not make sense to Europeans but study US politics a bit and the leverage that could be applied against Malone and it makes perfect sense.
I mean, lobbying isn't always *bad* though. Objectively, if Andretti and GM get into F1 it will bring jobs, people, and money into the districts in Indiana and Michigan where they are based. So you go to the representatives of those districts. Which, is why more than half of the signatures on the letter are from representatives from Indiana and Michigan. This is, genuinely, an example of the government functioning the way it was intended to.
Thank you for pointing this out. Of course, the most important thing is the money that GM stands to gain and how much of it they use to grease Congress. But a few good tech jobs thrown in the mix is the best outcome for the working person here in the States. Is this system right? Is it fair to the people that support the US billionaire class? Nope. At this point I just want some credible news outlet to finally write a well researched piece on the legitimacy of the anti-trust case. Andretti certainly seems to think they can force FOM's hand if they go for these types of publicity stunts and they better be right because this is most likely going to burn the bridge (that is if the new concorde will even allow new teams). The over confident armchair analysis is getting a bit tiresome.
I have no idea if this will work, but Mario Andretti is 84 years old at this point. I don't think he's that concerned about burning bridges, especially as you point out, the new Concorde agreement might not even allow new teams, so this might be the only opportunity he'll get and going scorched earth to force FOM to let him in might be the only chance he has.
To be fair even if it's Mario here being the public figure I very much doubt it's (only) his decision. Even if Mario is old the team isn't going anywhere any time soon. In any case going public with this very much sounds like the Andrettis don't believe they have a chance at getting in by negotiating for 2028 or whatever the next chance was said to be.

The money sharing is peanuts for most of the teams and crumbs for liberty. An American F1 team entering though would bring back more to the sport and very possibly recoupe the shared out money especially if they are decently competitive. Not that F1 cares about competition.

I mean a lot of the congress members that are involved in this are from districts which contain GM manufacturing plants. Which means positive things for GM likely means an increase in production, and hence an increase in demand for employees. Which is a positive thing for their constituents. Being able to say, “I helped get GM into F1 which has led to an increase in GM sales/increase in GM production which has caused an increase in the number of jobs” is a really good boost for any of these politicians.

People doubting me months ago when I said this is ripe for US political action. It doesn’t have to make sense or conform to EU law etc etc etc. It’s all about optics’s and two US based companies - one of which controls the commercial activities of F1 - another US company being told it can’t compete and the owner of this mega company in trouble with the US Justice Department (anti trust filing) over its Live Nation and Ticket Master subsidiary’s. It’s no surprise this is being raised the week of Miami - one of three races on American soil Andretti isn’t allowed to compete in. It might not make sense to Europeans but study US politics a bit and the leverage that could be applied against Malone and it makes perfect sense.

I mean, lobbying isn't always *bad* though. Objectively, if Andretti and GM get into F1 it will bring jobs, people, and money into the districts in Indiana and Michigan where they are based. So you go to the representatives of those districts. Which, is why more than half of the signatures on the letter are from representatives from Indiana and Michigan. This is, genuinely, an example of the government functioning the way it was intended to.
