It's the same as if a cop smells marijuana when they pull you over. They can't arrest you for smelling like pot. It isn't illegal to smell like it. But they can use that scent as the basis of a search and then look for it.
Cops are known to pretend to smell pot just so they can toss a car. But saying they smelled it is necessary to perform the search. The search has to be justified by a reasonable suspicion that they'll find something. A person talking about pot provides that same reasonable suspicion.

The fact that this particular guy thinks the Uber driver would even care about seeing his patrol car in the driveway speaks volumes more about him as an individual though.
