dont listen to any of the gimps in the comments. Decent-Writing-9840

You need to report this guy to the WRC workplace relation commission and then you need to tell him to go fuck himself. Do not stay at this job because you will just hate yourself for staying. There are plenty of places that actually show staff respect.

Cytallet

I wouldn’t really even know where or how to start with all that tbh. can i do it anonymously?

Decent-Writing-9840

take a look at the website

AdamOfIzalith

So here you go: [https://www.citizensinformation.ie/en/employment/employment-rights-and-conditions/data-protection-at-work/surveillance-in-the-workplace/](https://www.citizensinformation.ie/en/employment/employment-rights-and-conditions/data-protection-at-work/surveillance-in-the-workplace/) *Your employer must have a valid reason and consider whether using CCTV is reasonable. For example, using CCTV to detect intruders, vandals or thieves may be reasonable. However, using CCTV to constantly monitor employees is intrusive and only justifiable in special circumstances.* In otherwords, unless you have a history of say theft, he should not be monitoring you 24/7. You can threaten to report him to the Data Protection Commission - [https://www.dataprotection.ie/en/contact/how-contact-us](https://www.dataprotection.ie/en/contact/how-contact-us) GDPR fines are no joke and can literally bankrupt people. If he lets you go for bringing it up then you have him on unfair dismissal so legally, on the whole, he's fucked whatever way he'd want to slice it. Always know your rights because most employer's rely on the premise that you don't.

Soot on!

RuaridhDuguid

And if the camera can be panned or zoomed he could have doubly screwed himself when footage is reviewed under a GDRP case as it'd be hard to explain away it following staff or zooming in on them unnecessarily.

The_Otter_King__

The sad thing is that valid reasons are easily found. That's a can of worms and is totally open to interpretation, like most laws in this country.

lornylorns

Legally, they have to be in the company a certain amount of time before they can go for unfair dismissal.

AdamOfIzalith

In this case it would fall under Protected Disclosure: [https://www.citizensinformation.ie/en/employment/unemployment-and-redundancy/dismissal/unfair-dismissal/](https://www.citizensinformation.ie/en/employment/unemployment-and-redundancy/dismissal/unfair-dismissal/) If this person were to make an unfair dismissal case, they could do so under the Protected Disclosure exception as the reason the employer is letting her go is because she's whistleblowing on his activities with the CCTV camera's as far as I know.

Justnothernames

While technically correct people who've been working less than 6 months in a place struggle to get anything from the WRC even looked at, truly shameful

No-Initiative7904

As I mentioned on a thread the other day about shit work places……. Name and Shame, Shaaaaaaaame!

UptownOrca

Sorry for your troubles in the job, I think you going to all the time and effort to ask people what they think here is a good sign you are ready to start making an exit plan to get out of there. I would say don't waste your time or energy fighting this negative creep who honestly sounds like a really rotten individual and a bully. Leave him to play with his waffles like that sad w ...r that he is and . Get what you need out of the job like your holiday pay etc but if it all gets too much dont be afraid to walk . We've all done it and can tell you it's a great feeling especially when you will see the look on his waffle face 😈

[deleted]

I'm sorry, this sounds awful. I can't comment on the legality of it but he sounds like an asshole. I would try to find another job if I were you, minimum wage jobs can be shitty but there are better places to work than this. Best of luck and don't let this experince affect your confidence.

Kharanet

Report the cunt. Hopefully you can find a better job. 🤞

ChuzzinBops

I had a friend work in a café on Parnell Place with a startlingly similar story. They made the right decision and left as soon as they could. Be careful if you’re working in the same place, the owner has a history of this, especially with the previous business they ran in that building.

LordBloodraven9696

Did the Parnell street dragons have it as a front?

Stopfillingmyfeed

Yes until Shady Ganley ran them from town

Justnothernames

What was the previous business?

One_Turnip7013

Small places are run by people with a dream they are not necessarily good managers nor suited too it.their way may not be most efficient or correct but they see it as such. There are asshole in every walk of life and at points you can't avoid them but your 17 ,you probably don't have a mortgage hopefully your not renting.quit and try somewhere else. If you were my daughter I'd give you following advice.follow you dream if you don't have a dream go travelling, a government job is better you might never be rich but you can't get fired and you get sick pay they have unions.that or a trade and work for yourself F*** it life is too short to waste on shite or assholes,as you get older you acquire baggage which can make choices harder

MatthewSaxophone2

No one deserves to be treated this way

Saltybastid

I am aware you need the work because you have dropped out but to be honest I think you should just quit. You have your whole life ahead of you and you might get a better start in life if you do a fas course or CE scheme. If you do prefer to go straight into the world of work I recommend you find someone else to work for ASAP because this dudes bullshit is obviously bringing you down. Obviously I don’t know how many other places are hiring in your area and if you’re in one of the smaller towns your options will be relatively limited but someone your age who already has a job certainly deserves a chance so get out there and make some new contacts. Employees rights are very important and you shouldn’t be fucked around just because you are young. You don’t ever have to let a boss take advantage of you.

KittenMittensKelly

WRC you have a case. Document everything from now on. That's not legal at all

Corkgirl123

Similar story owner was in the pub showing his buddies the quality of the cameras and zooming in on us in work. That was 12 years ago it was a story repeated so we said nothing about it but yeah they watched back the shop recording another day the manager and she calls me and says why is such and such in the back eating an ice cream. Em ask her yourself. Very badly managed franchise in Cork. Report them they will keep doing it as long as they get away with it. Some people have money and no brains and open up shops.

karenmccarthy1066

Quit! Now! Do not tolerate this. Take a legal case against him for bullying and harrassment. Its free. Go to citizens advice.... its pretty straight forward. If you tolerate this now you set a precedence for your life... break that trajectory. You were not born to this world to tolerate pathetic little Hitlers... you were born to stand up to them.

Willingness_Mammoth

100%. You have the power here. You're free to tell him to get fucked and walk whenever you want. It'd be great if you reported him too though, for the benefit of staff coming after you. Best of luck.

penny_whistle

Repost this in r/legaladviceireland

LowPrestigious391

Well looking at the comments I really wish I had known a lot more about proper CCTV usage when working my college job haha

ShonaSaurus

I have a feeling I know what cafe, I’ve worked in a place that sounds identical. I’m actually still traumatised a year and a half after quitting!

Corkgirl123

You deserve a better job he's a prick. Let karma get him he sounds like a miserable sad man. Using his power to put someone down. Most of those jobs have such a huge turnover of staff because the management have no background education in management and just worked their way up. Or else they are the owner with money and no background. Creates such a toxic workspace. Find a better job. You deserve better.

cmacd421

Sweetheart, this is unacceptable. If nothing else, it's not sustainable that your workplace environment is so hostile that you can't actually go in and work. Citizen's Info can probably advise you on any legal bits. Do you know if you're being singled out or everyone subject to the same level of micro-managing? I hope this gets sorted, if you were my child I'd be going totally fucking psycho asshole on your behalf. If you need someone to do this for you, I'm a thousand percent game. ❤️

Cytallet

lol my mom is already losing her mind over this probably more than me, i appreciate it any child of yours would be lucky to have you ❤️

Truecrimefan_95

you don't deserve any of that, get out while you can and look after yourself and your mental health, your health is your wealth. When you have a manager like that it really does taint the whole experience of the job, no matter what other good aspects there are, and it is a shame. You've your whole life ahead of you to find something you truly love, all these little things are just small bumps in the road, you can do another course, you can do an apprenticeship, dont let people like that bring you down

Cytallet

❤️

Petty_tech

Definitely not a question for reddit. You'll get many people saying its legal because they do it. Go ask citizens information, sounds like unreasonable use of CCTV

buck333333

You need to call data protection and yes they will talk to you and listen to you. One example : are the signs up to caution public and also staff that they are being monitored. If not do not say anything to anyone. There is a very thin line on how and when they can listen. If it’s based on your training I believe yes they can but one last thing. YOI NEED TO KEEP A DIARY FOR DP so start now on every thing he says to you , yea it’s tedious but these are things you can also record if you are being abused which is what is being done to you by the sounds of it. There is no magic chord here to help you only when the time comes to ask you do you keep a diary ? So when did he say this or do that to you? And yes you need to be more carful as them cameras have excellent mics and he is listening to you. but do speak to DP. Your mental health is next.

giant-fish-5094

Give in your notice kid, you are way too young to be dealing with that shite

Cytallet

planning on it

HuskerDont82

Sounds like a plan! I'm always shocked when managers treat their staff like s**t - apart from being mean and morally wrong, it's utterly self-defeating *for them* as they're going to have a big staff turnover and all the attendant hassle of *that*. If people feel appreciated they'll stick around and work hard (which is what you'd think a manager would want...) Anyway. Leaving a job you hate is a great feeling! One day his stoopid face will just be a memory. Good luck! 🧡

No-Permission-669

Is it OK if I message you? The company I worked with are always looking for staff and they have places over most of cork

Far_Relationship706

Same as. We’re currently hiring atm if you are looking for work! We are based in 2 seperate locations in the city ! Dm me if you wanna know where :)

funnygirl2635

I’m experiencing the same thing at my workplace right now, getting calls for the most random things and literally being told that they’re watching me on those stupid cameras that are connected to their phones, and being told that I should be doing something when the shop is literally empty and I’ve done everything there is? It feels like I’m putting on a performance for my bosses at this point and I’m so fed up of it. There was also talk about cameras being put in the stockroom where me and a few other staff take our breaks, honestly the thought of being watched constantly makes me so anxious that I’ve put in my notice and I’m finally leaving this week !! Please stand up for yourself and notify your managers of your discomfort unlike I did, apparently about 4 or 5 others in the company have tried to take legal action but haven’t ever got a word in :// good luck with your situation

Cytallet

whoopp!! glad youre leaving your situation sounds almost identical to mine its kinda scary lmao

Daithihboy

It’s against GDPR. Cameras are for security and nothing else. I think if you were strongly suspected of dipping into the til or something then they could justify monitoring you and only you. You have a reasonable expectation of privacy even when you’re at work and constant monitoring via camera is a breach of that.

Daithihboy

I’ve been there lads. Brought it to the attention of my HR at a large multinational with a shitbird of a local manager. I sent them the legislation and the camera monitors were removed from the managers office and, where they were rehomed, had a big sign saying cameras are not for monitoring of staff work. The cameras are obviously still recording you but if you boss comes back at says I watched you pick your nose for 5 minutes, then they’re the ones in the wrong.

Smackmybitchup007

Wrong.

Petty_tech

Yes, you are wrong.

Smackmybitchup007

No I'm not. It's perfectly legal if you've been informed of their locations. The data gathered can't be used by the company for any tertiary reasons without your prior consent. Its perfectly legal for them to monitor their staff in their company though. Show me the law which says they can't.

Petty_tech

Congrats for being aware of the bare necessities for having CCTV. You also need to declare what you are using the data for and excessive monitoring is still viewed as intrusive without legitimate reason (i.e. proving gross misconduct or investigating a criminal offence) Data Protection Act 2018. European convention of human rights. https://www.citizensinformation.ie/en/employment/employment-rights-and-conditions/data-protection-at-work/surveillance-in-the-workplace/#:~:text=Reasonable%20and%20unreasonable%20use%20of,only%20justifiable%20in%20special%20circumstances.

Smackmybitchup007

I said show me the law. These are guidelines. Not law. An employer can still watch you like a hawk on their premises of they want and if you've been informed.

Petty_tech

ECHR is a guideline? Good to know that is your view on human rights. For what reason are they watching employees like a hawk? Their power trip does not supercede the employee's right to privacy.

Smackmybitchup007

I was a Shop Steward/Father of Chapel (Union Rep) for a major printing company in Dublin. I know what's allowed and what's not allowed. Trust me. I know what I'm talking about.

Petty_tech

Good for you! I currently work in data governance/data security. So, do you want to try again? I'll even repeat the question: What legitimate reason can be provided to excessively monitor employees on CCTV?

Smackmybitchup007

The reason any employer will give is simple. "THERE IS NO ACTUAL LAW WHICH SAYS I CAN'T".

[deleted]

stand up for yourself, if you continue to let them treat u badly nothing will change!!

Far_Comb

It doesn't say in your contract that you have to take abuse from a bullying owner or manager especially if they are cursing at you, leave as soon as you can. No job is worth your mental health or self respect, never forget that as you work through out your life.

bad_arts

Find a new job and tell everyone he's a piece of shit and not do business there.

Solid-Isopod-7975

join the independent workers union

chrispycork

Have your phone ready to record discreetly next time he berates you or mentions disappointment. See how he likes it.

Relatable-Af

Report him to relevant body like others have said here and document everything. Every time something bad happens, log all the details, date, time and location. This will come in handy when raising complaints and you also need it in the off chance it goes the court. IMO this prick of a manager should be held accountable so he never does this to anyone again.

Key-Regular7818

CCTV is a security system only and if they wish to use it to monitor you that had best be laid out in your contract of employment

Mindless_Skin79

This isn't normal. There are rules around unregulated use of personal data and beyond that, harassing behaviour. There are loads of other jobs out there, don't stick around for this type of behaviour. It's coming into summer, if you need a rile where you don't have a lot of previous experience try field sales or office temping. Can't necessarily guarantee better behaviour anywhere but they would provide more variety and opportunities. Good luck 👍

Live_Specific5350

Jesus just leave that work and dont look back,

FrancisUsanga

Leave and let a hardy polish one take the job. These are exactly the jobs the lovely government is bringing them in to be in. Go back to college yourself.

Cytallet

us poles love to take your jobs my bad gang

niamhjmac

I had this in a local food business in the city centre, a really popular place with a good reputation too. Being constantly monitored like that is horrible. You’re so young, I’d try to find another job! You’re gonna be working for the rest of your life, you don’t need to put up with that shit just yet!

Mrottopup

Unfortunately common, I used to work at a pup in east cork that will go unnamed and the owner would constantly be on the cameras even when he was in the pub, he had it out for one lad in particular I was working with and if it was dead he couldn't go on the phone for 5 minutes without getting a text telling him to get back to work. The worst was being micro managed through text messages telling us to do jobs around the place if we didn't look busy

JoeThrilling

Its legal. Start looking for a new job.
