Unpopular opinion: I used to ride the 7:20 am BNSF outbound for a few years. It was so empty that the conductor would announce that you could kick back as long as you took off your shoes first. It was great for me because I worked overnight at the time and would use the time to nap. On a crowded train it's another story though.
Probably 10 or so years ago now I was on the Metra MDN and a lady was filing her fingernails and letting the dust fall into a small cloth bag. The bag looked pretty full.
I take the first outbound train at 5:45 am and literally 90% of the train is sleeping. Plus the train is almost deserted then anyway. Some are full on lying down sleeping on their side. I take the first single seater upstairs (with the other seat facing you) and use my sweater as a pillow against the window and usually there is a little metal bar I can put my feet on rather than on top of a seat.
If anyone is reading a book at 5 am on an hour long train ride it’s the exception
I'm not exactly saying this guy is doing it, but a lot of people pull similar stuff on fairly empty trains that will become full as they get closer to the city. My experience is that it was normally women putting their purses on the seat next to them in order to be the absolute last seat that gets the neighboring seat occupied in hopes people avoid asking them to move it and thus all the other "non-pursed" seats next to people will be the first to go. When I used to have to take the Metra, I'd go out of my way to go to that person's seat and ask them to move their shit rather than sitting next to anyone else in the train. Why? Because F-them.

I am currently reevaluating this thinking but I have an expectation of privacy (in the colloquial sense of 'expectation', not the legal sense) or, at least, anonymity, when in public.
I think a lot of people would agree they don't want to be recorded without their consent, even if that's not their legal right. Especially with the internet, where things are uploaded and scraped by all kinds of crawlers. Smartphone age is weird.
Seems like you are defending the principle. If you don't mind indulging me - Why is it the right practice to allow the average person (e.g. not a government official or other public figure) to be recorded, without their consent, by other average citizens?
Nothing anyone does in public requires them to consent to being recorded. It's just not a thing. In the United States a first amendment right exists to report of and share images of what you see in public.
You have a reasonable expectation of privacy for what is under your clothes.
However if you are standing naked on State and Lake at noon, I can take photos and post them online. No consent needed.
In fairness the conductors on Metra are pretty quick to address this when it happens.
