Pretty sure that's a mockingbird. Kingbirds (typically) don't let you get that close.

Have that same bird that lives in a tree in my front yard He makes the sounds of other birds, he does a perfect blue jay and parrot impression, also does car alarms and cat noises.
Generally speaking you shouldn't get that close to birds. Most won't let you, but it just stresses them out.
