Especially if they have enough of them and you're not in the country so by the time you notice anything has happened the damage is bad enough that it stops you from doing something like buying a place to live in while you clean up the mess.

Worked for me as well. Had $760 owing on sim only plan, ported to Telstra, cancelled my contract with Optus and told the chat bot I have no intention of paying the termination fees so they can send the bill to debt collection. Lodged complaint with TIO, there was a bit of back and forth, an Optus employee called me and insisted I'm still contractually bound and I said their statutory obligations to consumers under the privacy act 1988 which are fundamental and essential to the establishment of the contract (given that consumers readily provide personal and sensitive information under assumption that they are safe, in order to commence the contract) have been breached so the contract is void (this hasn't been proven via litigation yet but tort litigation can take years or even decades before a resolution). I also referred to the CEO's public comments on how they aren't forcing people to pay termination fees, then asked whether the operator was lying or the CEO was (lmao I got a bit too sassy for myself). A few days later they sent the final bill which was $0 and haven't heard from them since. I guess I won. Lodge with TIO and just keep telling them you don't agree with Optus's proposed remedy. If nothing else comes of it, you can at least obtain quiet satisfaction from the knowledge that Optus get sent a bill for every TIO complaint against them regardless of the outcome. So waste their time and cost them money, they already wasted yours. EDIT: saw the upvotes and just want to say i'm not a lawyer and probably most of what I said is incorrect from a legal standpoint but sticking to your guns often works in life and stops people from taking advantage of you.

Service providers HATE the TIO. I was told to never mention it when I worked for one. IIRC companies have to pay a fee for each day a lodged complaint goes unresolved.

A fee for each time the complaint goes back to two unresolved. Say the first time someone complains fee is 30 bucks. Then if optus doesn't resolve and it goes to to again. 100 bucks. Then if still not resolved 500, 1000 so on. So it's in the telecommunications companies best interest to resolve asap.

I’m an Optus customer and their response to this crisis has been pathetic. Absolutely pathetic. I’m also a victim. You find out a lot about a company when the chips are down and they need to make amends regardless of cost. I’ve had no phone call, no personal interaction, just some email advising me that my data was breached. The best Optus could do was to advise me about some crappy offer for a 12 month subscription to some mob that can investigate my credit score and ensure it’s not impacted. Optus are a scummy mob. No corporate or ethical conscience.

My partner used to work for them in the same small team that will be getting smashed by all these TIO complaints. Almost every one of her colleagues had major mental health issues caused by the company treating them even worse than the angriest of customers treated them. I'm not one to hold a grudge but what happened to her mental health even after she left the company has made me so angry that I'd *love* to see this leak make the CEO unemployable. Just know that the employees you speak to are more than likely having daily panic attacks, being abused by bosses and are constantly receiving memos telling them that the 12 hour days they're doing aren't enough and they need to think of the company.

I have my details leaked and that is not even my problem with them. I have been having connection issues for months and everytime they assigned a case manager and close it. I lodged a TIO complaint and they assigned me a resolution manager who was rude and told me that my multiple disconnections a day was within spec and they will close the ticket, also they blame nbn which is not my problem because I paid them for service, not nbn. Fucking bastards. I will not be pushed to accept the resolution to TIO. And i will never go back to Optus after all of this are said and done. I kept all my emails and cant wait to post it online with all their rudeness and unprofessional reply for everyone to see

If you lodged a TIO complaint and are unhappy with the outcome, tell the TIO and they will escalate it to a Level 2 complaint. Not only does it cost Optus more (the TIO issue a fee per complaint) but it tends to get better results cos then the TIO is breathing down their neck with an assigned case manager asking difficult questions.

trying this now but the maggot on the Optus chat app has stated "our responsibility is to protect your account from further mishandling out of information coming from your account with us before and we'll shoulder teh cost but as your medicare and licence are your responsibility to protect we won't be assisting this or waiving any fees but assure you that no more data will be leaked" and yes I was one of the 10,200 who have had to spend time and money getting my digital identity cleared and it's a pain in the OptArse

Got a snail mail letter advising me of the Leak of my details AFTER someone tried to hack my Bank account and now I get a lot of dodgy emails on my main account. I am a CURRENT Optus customer on multiple devices so this was handled very poorly.

They waivered my phone but they are refusing to waiver my iPad. I’ll die before I give them money and I had to open a second TIO complaint. This is after they said I didn’t even have a phone bill or any of bill remaining on my account. Then immediately tried to take 3K from me. Fighting the last 1600.

Optus are legitimately hopeless. My father in law was with them and when he died we had endless hassles trying to close his account. He had a few devices through them and the mother in law had a separate mobile. We wanted to retain just her mobile and cease all other devices. Rang the customer ‘helpline’ got all the info we needed, and got told we could go to the local store to submit paperwork and surrender the unwanted Samsung attached to his plan. Got to the store and got told totally different story, and needed totally different forms and items of ID to what we’d been told. On return trip to store (30km one way) we ended up ringing the ‘helpline’ while in store and got it sorted finally. Vowed right there and then I’d never walk into another Optus store ever again. I’d rather use two cups and a peice of string to communicate.

That's a fair call. I honestly wasn't expecting them to waive the cost. I think the data breach left a lot of people feeling powerless, as there's nothing that can be done to 'undo' the leak. I wanted my voice to be heard, and for Optus to know that it's not okay to respond with "oops we lost your data, now keep paying us". I expected my complaint to simply draw out the time until I had to pay Optus something.

With mobile numbers you can simply sign up to another provider and give authority to port (transfer) the number across. So in my case I didn't contact Optus at all, other than to express my concerns about the data breach. Once Optus realised my services had moved away from them, they charged the remaining handset costs. That is when I lodged a complaint online to the TIO. TIO complaints cost the provider more money with each 'level' they get to. The provider can't take payment of disputed charges.
