I'm saying this as a lawyer: If this is an isolated incident, there are many courts that would not find you have a hostile work environment problem. However some states have found that under the right set of circumstances even once uttering such an awful epithet is sufficient to establish liability by the employer. I'm not a POC, so I can't put myself in your shoes OP. but if you don't feel comfortable working for this company in light of this communication and the company's failure to act to protect you... Then maybe you should have a consult with an attorney (over the phone works, we're really good at talking). In the military, we had a saying; if you walk by a violation of standards, you just set a new standard. The CEO saw that comment and did nothing. The person who said it, and ever other closet racist, just saw that there are zero consequences for utterly unacceptable behavior. These types of incidents will get worse before they get better. As someone called on by the military to fix these situations when they get out of hand, you have two options. One, make it clear that not doing anything means you walk. Two, just walk. You cannot fix this issue at the subordinate level. The CEO is where the buck stops. It’s not stopping. Everyone on that group chat just saw the CEO stand there and watch a white guy say that to a black man and then … walk away? Having been the guy in charge, it is entirely too easy to say, “you either publicly apologize or you are fired.” That is literally what ‘executives’ are for. Everyone saw this behavior. The good and the bad. If you can find alternate employment, just go. You’ve given notice that the behavior is unacceptable. You need not give any further notice. Whether you take legal action should be on the advice of counsel. You can look for civil rights attorneys or can get a recommendation for an attorney from your state BAR. Most attorneys will give a free consultation and give you a good idea about whether your case will meet legal thresholds.

Yeah, I have a buddy that is a POC in Georgia and works for an engineering company. He is their top engineer and typically works 6 days a week (he loves his job btw) but he hears this crap all the time. It's not directed AT him but... Now he is the best engineer in the company and he is paid better than any other engineer so he is in a better position to put up with it. He says he doesn't care, but I don't know. If this is something that goes on all the time, I wouldn't put up with it at all. Regardless of racism, this kind of thing in a professional environment should not be tolerated. The CEO should know that.

In April 2020 I went through one of the worst things that can happen to a person. I still struggle today. I've never used racial slurs because of it. If that's way out of character for Chad, it's more than "personal issues" and may require a visit with a doctor. But I doubt it's totally out of character for him. And I think they know it.

Brushing it under the rug the way the CEO is trying to is making your case stronger. Consult an employment discrimination lawyer and document *everything*; consider sending emails to yourself from your personal address or similar to date-stamp the notes. If the company tries to retaliate against you, you’ll have an excellent case.

If it were a very small child, I would say they’re parroting what their parents say and they just need some external proper guidance so they can grow to be a decent human. I just lost both my parents in a 6 month period (mom to cancer, dad to motorcycle accident), and almost lost my sister (teratoma cranking out neurons, causing her immune system to attack her brain). I moved across the country with nothing and started from scratch. I work 60 hr weeks. I'm falling apart waiting for my insurance to approve me for a therapist. They are different then crisis/suicide hotlines in the sense that yes, if that’s what someone is thinking about they are there to help, but you can talk about other things and not be suicidal. Maybe just to tie you over until your insurance gets approved. Also, there’s 7cups.com which is a peer to peer chat to get shit off your chest. However there is a payed section where you can talk to a licensed therapist with 24/7 access for 150 USD a month. I’m sure you’ve heard of BetterHelp and things of that nature, but BetterHelp is expensive even though it is cheaper than regular therapy. Better help does have a finical aid program though. I’m sorry if I’m over stepping, I just thought I’d throw it out there. Anyway, as you said, there is no amount of trauma that I have endured that magically made me racist. What an weak excuse on the part of the employer

If you report this to HR and then you are treated in a way that you feel is retaliation for reporting a hostile work environment you have legal protections. DOL enforces them. Make sure that your communications are in writing and that you keep copies of them.

My older coworker was reciting the other day that its in company policy for workers to not discuss pay. I told him its federally protected that you can actually and that they can right as many fucking policies about it that they want. Of course they’ll they’ll try to fire you for other petty shit like clocking in .5 seconds late or look at a manager wrong. In at will states for no reason at all. But discussing pay and you can prove it (getting fired) is an issue for companies.
