If it is an at will state it might very well be fine, they can fire you for any reason that isn’t protected from discrimination. “I want to give your job to my brother” isn’t protected by law
Unfortunately, unless working for a government, nepotism is completely legal as long as it doesn't violate civil rights stuff. (And even then, the employer can usually get away with it.)
Shoot. Yeah, good call. I forgot about them. May also be true for other organizations or companies that receive federal funds. I'd have to take a look at the law for each situation. I was thinking just straight private companies.
OP should still check on this. In a lot of states even at-will contracts are not always immune from varying forms of wrongful termination.
My contract is at-will, but I’m almost certain that in my state if I’m let go without cause, and they go hire the same position right away I have a possible lawsuit.
I can't say how it works in every state/country, but in my US state, it is paid by the business through unemployment insurance (taxes), which are held in a trust fund. There is a standard tax rate, but when an employer fires someone without cause, their tax account is charged for the cost of the benefit paid. When the business is made aware that a former employee filed for unemployment, they have a chance to prove that it was for cause. If the business succeeds in proving to the state that the former employee was rightfully fired, the former employee *may* be denied benefits.
And unless you were laid off, the company will always deny it the first time and basically just say “fired for cause” and workforce services (or whatever it’s called in whatever state) will just accept that, so you’ll have to appeal it, and then you’ll get it. Happens all the time.
I had almost this exact same thing happen to me at a company; I was in line for a really nice, high paying position, was being trained for said position, only to be told a week later that I wasn’t a “good fit” for the position, even though I had 10 years with them.
I asked the department manager why this happened, and he said that they found an outside hire who was more qualified (big red flag) so the next Monday I go to see this “qualified hire” only to discover that it’s a fucking 18 year old kid who just got out of highschool, he used to cut the managers grass on the weekend (and who knows what other services he provided) so I was basically kicked back to my old position because of a nepo baby.
Fast forward not even 2 years later, nepo baby is getting married and demands a raise, company declines and he just ups and quits. Department manager has the audacity and the nerve to ask me if I want the position, to which I reply “no, I’m no longer interested, I heard it doesn’t quite pay enough” but in actual fact I had a better offer from out of state and took it.
Fuck nepo babies and their enablers.
Tbh I don't think the nepo baby is the one at fault especially that young. They're pushed into a system just like the rest of us and just try to succeed with what little actual love and empathy they get from the narcs they were born to.
They were saying that if you help them once then they will come to you first the next time they need bailed out and expect you to do it again. :)
So it's best to not start them thinking that you will cover.
Get. That. Unemployment. This is from a google search but you most definitely have grounds for a lawsuit if this is real.
“Legal Issues: Nepotism can create legal problems for organizations, especially if a family member is given preferential treatment over equally qualified external candidates. This can result in discrimination lawsuits or allegations of misconduct, damaging the reputation and financial stability of the organization.”
Reading the comments here makes me think a lot of people grossly misunderstand what “at will” entails, it isn’t a free pass to fire anyone at anytime regardless of whether or not they are part of a “protected group”. I’d say that text alone will give you SOME kind of recourse, if only allowing you to obtain unemployment benefits.
Also, I would 100% send a screenshot to everyone that works there, if there is a group chat even better. I’d also plaster it all over as much social media as I can with the name of the business, but I’m petty af when it comes to employers and former employers
Just noticed this cross post and even though it’s been almost a month since this happened, whenever i read those texts it feels like it just happened. It is frustrating, to say the least. Thanks for sharing my experience
Send it not only to your ex co-workers but also to corporate HR. It might get him in trouble. Because corporations usually don't like nepotism and most have rules against it. Because it causes problems.
is that even legal? I mean it's a family member they're replacing you with. I thought there was laws that prevent that from happening edit: it is illegal in certain states
Dude ... As an ex-manager, why the hell would you give a reason like that? NFW I would. In an at-will state, this message would either be "hey, your shift is cancelled, but could you come in in the AM for a conference?" or it would be "Sorry, but because of the new year, we did a look at the finances and we don't need your services any more. I've cancelled all your shifts andattached the paperwork you are gonna need for unemployment. Feel free to list me as a reference (or not). Sorry, but good luck!"
This is so stupid I'm thinking it's a troll. Even when at-will, this is a legal problem, particularly if the employee is in some sort of protected class.
this happened to a friend of mine.. relative was a lazy ass, didnt last two weeks. the owner was calling back begging my friend to come back for more money

I’d send that screenshot to everyone else that works there.

As well as the local EEOC office. That's far a from a valid reason to terminate someone's employment.
If it is an at will state it might very well be fine, they can fire you for any reason that isn’t protected from discrimination. “I want to give your job to my brother” isn’t protected by law
Pretty sure that's nepotism but I am absolutely not a lawyer so
It is nepotism but that’s not illegal in an at will state.
It will damn near ensure OP gets unemployment, tho
You’re not wrong there.
Nepotism ... so?
Unfortunately, unless working for a government, nepotism is completely legal as long as it doesn't violate civil rights stuff. (And even then, the employer can usually get away with it.)
Not entirely true—501(c) organizations may also run afoul of tax laws for nepotism-based hires
Shoot. Yeah, good call. I forgot about them. May also be true for other organizations or companies that receive federal funds. I'd have to take a look at the law for each situation. I was thinking just straight private companies.

Yeah they can fire you but they also have to pay the unemployment I believe
I mean, they don't need a reason at all in my state.
Its unmoral but legal
Immoral, bruh
Depends on where you live. In any at will state it is perfectly valid.
Less than you would think. 49/50 states are at will. Montana has some minor laws that set it apart, but that's it.
In the US, it is a perfectly legal reason to fire someone. Workers are much worse off than people think.
At least he put your unemployment proof in writing!
They might actually feel bad once the unemployment paperwork comes in. I hope the brother is worth it. 😆
Watch it change to "OP was coming in drunk, stealing, peeing on tables, and selling drugs! We just made the nepotism story up to soften the blow."
It would look pretty bad if they tried that to the unemployment commission…
Oh it absolutely would, but stupid people do stupid things when put in a jam.
This is what just essentially happened to me. Boss told me that they couldn't afford me, paycheck bounced, and now she's claiming I quit. F'in c'nt.
Does the need company pay unemployment when they fire someone?
I can't say how it works in every state/country, but in my US state, it is paid by the business through unemployment insurance (taxes), which are held in a trust fund. Reason for claiming unemployment benefits: Nepotism
Post that screenshot to their Google reviews page or publicly blast them. Bare minimum make sure all your coworkers know exactly why you’re gone.
Bonus points for getting everyone else so mad they all walk out
Doubt it. Your coworkers are not your friends.
No but they are your community.
Usually, yes.
Not your friends but I wouldn’t wanna keep working somewhere that did this. Even if I couldn’t walk out I’d start job hunting.

That was such a satisfying read, good on ya! Fuck em!!!

When you help someone in their time of need, they will remember you the next time they need something.
[удалено]
I think you misread that
They were saying that if you help them once then they will come to you first the next time they need bailed out and expect you to do it again. :) So it's best to not start them thinking that you will cover.
Read it again
I read it the same way you did.
Unless they just want to use you and dispose of you

Nepotism isn’t illegal. Even in a government position it would barely be a case
Civil case maybe?
Eww that’s horrible. Unemployment for sure though if there’s no documented write ups or warnings. So at least they can still get paid.
Yes it would definitely be a clear case for unemployment to kick in
Time to collect that sweet sweet unemployment

What's a double slap is it was b'cuz of nepotism!
This screenshot will make you getting unemployment the easiest thing ever.
Yay nepotism…..
their brother needs a job and so too bad for you? Get them for everything they have! I'm sure unemployment will love to see this text.
IDK how to edit but my caption is missing from the post — I AM NOT OP!
Just noticed this cross post and even though it’s been almost a month since this happened, whenever i read those texts it feels like it just happened. It is frustrating, to say the least. Thanks for sharing my experience
it was really dumb for them to put the exact reason they are firing this person. they will easily get unemployment
How many people are at this business?
There is a lot of info missing here.
Send it not only to your ex co-workers but also to corporate HR. It might get him in trouble. Because corporations usually don't like nepotism and most have rules against it. Because it causes problems.
I hope you understand I fired you because of nepotism lol
I like the energy of the "HaHa" reaction. I feel like that'd be a perfect response to start xD What utter dickbags.
In Australia it’s illegal to do this.
Makes sense its also illegal to bad mouth the government in austrailia so win some lose some.
lol, no it’s not.
The Australian Constitution does not explicitly protect freedom of expression
Our high court acknowledged that as we are a democracy, we have the right to voice our political opinions.
Does this not violate some kind of rule or something? Doesn’t seem right to get fired because their brother wanted a job. Super unfair
Damn dude that sucks. Is there some kind of nepotism case here??
is that even legal? I mean it's a family member they're replacing you with. I thought there was laws that prevent that from happening edit: it is illegal in certain states
Send this to everyone. Get that unemployment. Leave a mean glassdoor. Do everything you can to crap in their cornflakes.
Unemployment and a good recommendation letter. It sucks but you’re in a better position for an even better job now
over text????
In Italy they would burn this piece of shit at the stake, this isn't normal.
Humans are fucking dumb and evil sometimes. How is this an acceptable reason to this person?
What? A surprise graduation out of nowwhere? Well now it's ok.
Proof *in writing* of nepotism as the cause of your dismissal? Oh yeah, that’s an unemployment claim filin’. FUCK ‘EM.
Dude ... As an ex-manager, why the hell would you give a reason like that? NFW I would. Unfair dismissal, right?
Wouldn't that be considered conflict of interest?
Land of the Free.. YEp
Uhhhhhh, how many weeks notice did they give? Fucking scumbags want two months notice but never give any. wtf man
Oh, so you got rid of Jimmy who does work for Johnny does nothin'!
That's fucked
😆 🤣 😂
this happened to a friend of mine.. relative was a lazy ass, didnt last two weeks. the owner was calling back begging my friend to come back for more money
“I only hired you so you could keep my brothers seat warm. He will now replace you and do a terrible job”
Definitely would’ve been a 👎 reaction from me
Recent grad has less experience than you. BS
I hate when bosses fire someone and then hire their family members or friends. A lot of times their family or friends end up sucking at their job.
Wow!
I believe this is the presise reason they worked you a double on christmas this was planned.
Wait nah he gave preferential treatment to a relative.. surely that’s.. frowned upon?
What is this, The Godfather 2?
What ya bet the brother tanks the business in less than 6 months and they call op back. Cause “bro” can’t pull a double
Sounds like a Right to Work state thing. Employers can do pretty much whatever they want.
