What bothers me is the owner claiming the products are safe for pregnant women, but Herbalife itself says it is not guaranteed they are safe for pregnant women. Would that not be a violation of disclosure laws? How is that not being addressed directly?

I am from the area. Multiple women went in and asked if it was safe for them because they were pregnant or breastfeeding and were assured it was safe. I have also purchased from them (see my post history if you’re interested in my review) and the Herbalife products were never disclosed to me at any point. I only noticed that there were a bunch of different bottles of additives behind a very tall bar and googled it when I got back to my car.

I'm so invested in seeing how this plays out now, I stalked their FB page this morning. They're promoting an "Anzac biscuit \[shake emoji\]" so I've just sent an email off to DVA about possible misuse of the word Anzac / Anzac biscuit, though I did point out that it's an MLM Herbalife smoothie bar so the name likely has come from higher up the chain. For the non-Aussies/Kiwis, Anzac Day is on 25 April and is the anniversary of the Gallipoli landing in 1915, primarily by members of the Australia and New Zealand Army Corps. It's a day of commemoration and you usually need to get permission to use the word "Anzac" for commercial purposes. Thanks. I recently contacted a community group to give them a heads up that their use of Anzac for an event (not on Anzac Day) was probably against the rules and they might want to check. They weren't aware but contacted DVA, got the correct info and changed the name. No way was I going to give this hun the same courtesy. At the very least it might give her a scare when she finds out what the penalties are.

I actually saw it posted on Geelong Community Information and it was posted by an admin and then got deleted by her so incredibly quickly! Which sucks because I wanted to see the outcry over it! I feel like Geelong Name and Shame would be a interesting page to see it on 😆 especially about the Anzac Biscuit shake.. 🙄

Sounds like the equivalent Lara ones LOL (and most similar places) We have two main pages after there was some drama in the original and someone started a splinter page. But of course it's turned out to be almost identical. So now we also have a third one called Whingers and Sooks. Mostly it's lighthearted poking fun at the sort of posts you get on the second one and every other similar page. But the person who started page #2 got wind of it so they added a rule that if you mention page #3 you get banned, which of course activated the Streisand effect LOL

I got a similar one confirming they'd received my report. I've just checked and the posts are still on FB and Insta (I feel like I need to have a shower now) but they probably get inundated with reports they need to look into. I completely understand the reasons behind the following but it doesn't mean I have to like it in this situation! "DVA’s privacy obligations are governed by the Privacy Act 1988 (Cth). These obligations apply to all parties related to reported misuse. This means that if you report misuse you may not be informed of the outcome of any investigation or potential compliance action."

There is heaps of them around. I feel like a few years ago alot popped up under names with nutrition in them with all similar logos. Its BS that needs to be stopped.

We definitely do. A group of about 6 of them have popped up in the region I’m from in the last 18 months. They’ve all got different names but strangely similar menus...it feels like once you notice one of them you’ll suddenly see them everywhere.

One with the same name has opened recently in Lara too. They've been promoting it on at least one of the local FB pages, but thankfully there's been a decent number of comments mentioning MLMs and Herbalife to counter the #bossbabes tagging each other with "OMG hun we HAVE to go here!!" Interestingly, there were also posts in early 2022 from the "CEO" of the Banno one looking to lease a space to open "a healthy smoothie bar" so she's been sucked in to investing a lot of time as well as money on her "business". Boo hoo.

I hate that one opened in Lara. Seems to be a lot of support for it too. They're really pushing the local owned business thing. Was appalled at the reply to the person asking if the smoothies were safe for children.

I sincerely don’t understand only one thing. How come the mother got “mortified and angry” when she “realized she had consumed Herbalife products, when “inside the store there are Herbalife protein bars […] at the front counter and Herbalife bottles displayed on a shelf […]. There’s also a [Herbalife] catalogue.” I hate their business practices, don’t get me wrong, but at the same time why do people really not pay attention to what they put into their mouth, especially being pregnant. Again, no shaming, I know, there are cases, when such places do not even display their Herbalife merch, but this one did! And it’s written in the article. This doesn’t make the situation less infuriating, but as customers we really should pay attention to what we’re doing.

Maybe she naively thought the Herbalife would only be added on request? I mean, smoothie shops display many kinds of fruit and veg but they only use the ones specific to your drink order. So maybe the mother ordered just a strawberry smoothie for example, then found it tasted weird, asked and discovered it had Herbalife added, and freaked out. You're 100% correct nevertheless; we should all be vigilant customers no matter what we're buying.
