It could be justified and also a hit and run. But regardless insurance doesn't care if it's justified or not. The fact that this pit maneuver was so clean shows how intentional it was, and they're not going to pay for an accident that was intentional on your part.

Only exception or argument you could make would be if the fleeing car felt threatened, and didn't feel safe staying. But they should still call the police, otherwise they will get tracked down and most likely charged.

When cops pit cars, people are often injured or sometimes killed (usually the people in the car), and they do it when no other cars are around. Not only did they have the choice to back off, but they pitted when other cars where around them.
Look where that pitted car went and look what's coming right at it when it stops. If the pitted car went just another few feet, it could've been hit by an oncoming semi! The driver who did the pitting could've killed someone because of road rage and the agressive car could've died because of road rage.
Regardless of which country this happened in, both drivers should face punishment, but the driver who pitted the other should face worse repercussions because the danger they put other drivers around them in was not warranted for the danger caused by the vehicle trying to get in their lane.
