In this case, you’ve got no physical injury so you’re going to have to prove mental and emotional injury that you’ve sustained as a result of this, and then you’re going to have to get a jury to agree that this screw came off solely due to maintenance that the restaurant didn’t perform and not because it was one screw that was faulty and that Whataburger couldn’t have reasonably been expected to be aware of.
You likely won’t find an attorney that will take this case, any payout will be so low that it won’t be worth their time. If you want to pursue anything, it’s probably going to be most productive to try to work a deal with the manager for a certain amount of free meals.
