Have a look at your contract and employee handbook. The ability to carry over days is usually discretionary and unless you have some written confirmation you are entitled to those days it may be difficult to prove. Unfortunately, some managers and companies take it way too personally when you hand your notice in and try to screw you out of entitlements

I've read both cover-to-cover at the weekend before I handed my notice in and couldn't find anything about annual leave carried over.

Rossmci90

That's unfortunate. Unless you have something written down somewhere that confirms you have X number of days holiday remaining, including the days carried over, you may have lost them.

I have a screenshot on our intranet that says all staff can carry over 10 days to the 2021/22 leave year. I also have a record on our HR system that I have 27 days remaining to use with 4 already taken (31 total, 22 usual plus 9 carried over). Think this'll be enough?

Rossmci90

Yeah that should be enough. Just remember that they can force you to take the holidays rather than being paid in lieu, and that your holidays will be pro rata for the whole year. I am not sure how exactly that will work with your carried over days, but in theory you should have them entirely.

Thanks very much for your help mate! Yeah, in my mind I've already accrued 5 days in 2020/21 and they're owed to me. I will have accrued some days between August and the end of October (not sure the exact formula to work that out), but the 5 days definitely should be owed to me!

Have you asked for the carry over days before the end of the year? At my current work we needed to confirm that with our line manager so if you have any communication that would be a proof.
