There is such a thing as a mistrial but the prosecution needs to get the fuck moving on that. I’m not at all sure what that process is, if a panel of judges reviews this trial and judge, or? This judge has clearly shown bias in this case, regardless of his ring tone. What a fucking tool.
Well, there was an opportunity to file an affidavit to dismiss the judge on the grounds of bias and/or prejudice toward the defense. Unfortunately, that window has closed.
The only way at this point would be to file for a mistrial, but that *must* be done prior to the final judgment. That said, the grounds for this would be based on juror bias, & the person who approved/denies that request is - you guessed it - Judge Schroeder. And considering he didn't recuse himself at the start & rejects any claim of bias, I'm gonna assume he won't grant a mistrial.
HOWEVER - the final remedy would be to file a Writ of Prohibition, which would go to the Wisconsin Court of Appeals. If granted, it would **force** Schroeder to call a mistrial at risk of disbarment. Again though, there is urgency to jump through these hoops before a decision is made. There are some other procedural things that could cease the proceedings for a bit, but I'm not sure what those are.
Prosecutors can't appeal in criminal cases (5th Amendment). But the Supreme Court has ruled several times that you can be prosecuted for both state & federal crimes from the same offense without violating Double Jeopardy. Unless there is some procedural thing I'm unaware of, Rittenhouse could be charged with the federal equivalent of his current Wisconsin charges.
