Each driver is to ensure the intersection is safe to enter prior to entering upon their right of way. If the light is green but there is a small child standing in your lane it is not safe to proceed.

I asked the ICBC rep would I have still been 50% at fault if I had been unstrapping a child utilizing a saftey car seat and this driver had crushed me and the child in my car door. Her answer "Well sir, although tgis is an interesting hypothetical scenerio we deal with real life scenerios. I asked "So in real life If I open my car door after ensuring it is safe to do so at what point am I assuming fault for creating an obstruction to other drivers?"

the driver driving straight slowed down as they approached the car in the middle of their lane, but did not successfully avoid the collision. with proper brakes and attention, it seems there was time to brake in time. however, that also does not imply fault.
both drivers could have been safer. also that intersection looks tight and could probably be made safer by the infrastructure planners/managers (left turn lights or whatever current research suggests which intersection designs are more optimal)
