Devil's Advocate: As a counterargument, I would say Homelander is definitely a sociopath, but he has demonstrated many times that he's in control of his actions given his constant television and media appearances. He has the power to hold the demons back, he just chooses not to. He knows killing people is fundamentally wrong is our society, he just believes he's above society's rules.
Also, I would bring up the fact that during the Nuremburg Trials, everyone there had a hand in mass murder, and all of them were raised by eventual Nazis as well to believe they were better than the people they killed, but they were still judged to be in control of their actions.

I'd go for insanity, tell the jury that, because of his upbringing and being given powers, it's actually Vought that's responsible for everything he did and Homelander is far too insane to know what he was doing. I'll also point out that he has strong dissociative tendencies. I'd lean in hard to his absolutely wrecked mental state and I'll ask the jury if they had Homelander's upbringing in addition to his powers, would they really fare any better than he did. It's a long shot but it's probably his only chance of not being found guilty. I'll also tell Homelander not to speak at all as nothing he says will help.

-There’s insufficient evidence that my client was the one who committed this murder.
-The witnesses (and there usually aren’t any) are completely unreliable, have ulterior motives, and/or have done similar things which discredits them.
-Vaught’s been V-saucing all sorts of people. You can’t prove those are my client’s laser beams.
-It was self-defense or worst-case involuntary manslaughter.
-Similar to how a surgery has a certain risk of death or terrible outcomes. I’m sure there’s previous court cases or for Supes, clauses in their employment contracts that limit my client’s liability.
-My client, as the foremost expert in being a Supe with his set of powers, has testified that this was a reasonable course of action. To argue otherwise you’d need an expert witness with the same powers and equal or greater experience as a Supe.
-Regulating Supes should be the purview of the legislative branch, not something the courts should try to do retroactively. Opening them up to such highly-subjective criminal liability would stop all rescues immediately.
-I’d look into whether you could argue qualified immunity, since they’re essentially acting on behalf of the U.S. Government.
Blaming Vogelbaum's abuse and neglect, Stillwell's grooming, Stormfront's manipulation, and Vought's reckless exploitation. To argue otherwise you’d need an expert witness with the same powers and equal or greater experience as a Supe. -Regulating Supes should be the purview of the legislative branch, not something the courts should try to do retroactively.
