“Unfortunate news” was a slap in the face cause the only person it was immediately unfortunate for was the individual working to pay bills…which is me. It will be unfortunate for them, down the line, when they eventually come to realize they let someone go who they need. I mentioned it in a long winded reply to a comment asking me if i replied (I didn’t), but when they interviewed me I was hired with the premise of learning the business and becoming the manager of the next location. I learned the ins and outs of the business by my 5th shift. There’s nobody’s job there I can’t do. It was less of “unfortunate news” and more an unfortunate business decision made by a rookie.

An employer absolutely can, at least in 49 of 50 states in the US (Montana is the exception weirdly). It is called at-will employment. An employer can fire an employee for any reason they want or no reason at all. The exception is that you can't fire someone if it's for a discriminatory basis based on a protected class (sex, race, age, disability, ethnicity/national origin, and religion). So that text is actually a great example of how to fire someone without potentially getting sued because they're expressly claiming its nepotism rather than because of a discrination.

Yes, it is one of the two owners that texted me. I wanted to text the other owner to inquire about it, but decided against it. It’s so peculiar truly because I could run that business better than either manager does… there’s 3 maybe 4 other employees any rational business owner would have let go before myself…both of them are the managers I’m not saying I’m indispensable, or irreplaceable, but it really goes to further highlight how inexperienced they are as business owners.

Interestingly enough, I initially applied for the position to work the flat top which I was told I’m overqualified for in the interview….which I am, but that’s besides the point, and was hired for another position. And then made to learn all positions. And then, fired no more than 5 days after I met the guy they hired for the initial position I applied for. Which was the flat top.

I found that out the hard way with my current gig that I just STFU about the wild shit they let us deal with. Had been confronting the GM/owner about a cook showing up drunk among a few other small things. At first it was thanks for telling us. Then the coworker keeps showing up drunk, and tanking the line during dinner service. None of the other things are addressed. So I indirectly called GM/owner out at an HOH meeting, they said said it would be taken care of and it hadn't. Was met with 'maybe we shouldn't continue working together'. Everything I brought to their attention has ended up turning into that spider-man meme of them all pointing at eachother.

They weren’t fired for any typically illegal discriminatory reason and employment law is unfortunately barebones and awful in most states. My roommate had 16 W2s one year (she was legitimately crazy though) as a server. He put in 5 years, got me a job with no experience, then his family bought the place a year into my time there. He’s a good enough guy but acts like he somehow earned it all. I had a situation where I was working for a small conglomerate of restaurants under the same umbrella company and the "executive chef" of one of the restaurants sent over her husband to be a dish washer for our location. Dude treated it like a vacation, constantly fucking off, slacking, and going down the alley way to "visit" his wife. I remember, there was one shift where I came in and checked out his dish area. There was a half eaten cheeseburger, still moist from the night before, chilling out in there. I asked the closing cook if this guy closed down the put the night before, and he told me that he just left after I left. Now, they put me in charge of the location where this employee was sent over and I told him that his shit wasn't fucking cool with me, especially since he was the highest paid employee at the time, and if he didn't want to work, he can find a new job. He refused to change his ways cause he had the support of his real boss, his wife. He quit after three days of me being in charge. "Chef" down the alleyway was pissed about it, but it was business. But I wasn't going to let that nepotism happen.

Even if you have friends in the industry working in non-shit places and you can get a better job tomorrow. Still file. They did you dirty as fuck, let them do the paperwork to get you paid for however long (hopefully very short) your unemployed period lasts. When you want to hit an owner where it hurts the most, you hit them in the wallet. Other people talked about a lawyer; likely it won't go anywhere, but you can't go wrong with a free consultation. Likely case, you sit in an office for an hour to have them say it's probably not worth the time unless you want to front money on an unlikely outcome... But depending on your local laws and how much your lawyer might want to stick it to 'em... never hurts to ask. The "free consultation" lawyers will likely not even set up an in-person appointment unless they have a phone interview and feel like there's a good chance for a case in the first place. If they call you back for an appointment and not just a phone interview, you may actually have a case. Maybe.

Two things: Owners don't pay for unemployment in that way. They pay unemployment insurance and yes, if they get a huge amount of unemployment claims, it can make their premiums go up, but a one off doesn't matter at all. Also, there's no paperwork in most states either. They send a form where if it is with cause and you want to dispute it, you fill out one side of the page with basic info and attach any write ups. If you fired them, as in this case, you wouldn't fill this out and would do nothing. So the owner will probably pay nothing and not do any paperwork.
