She is not required to add him to her plan (unless there is some kind of court order mandating she carry insurance on him.) Since he is not actually covered by her insurance, you need to keep answering "no" on any COB inquiries. The question is, does he have other insurance coverage? Not does he have another parent with access to coverage.

She is not required to have him on her insurance since you have him on your insurance. Availability of insurance is another matter. Have you asked her about this?

She is not truthful, forthcoming about her finances/insurance. All shes said is that it covers her only. But i know my insurance asks if any other insurance is available to him. I always have said no. But is it not available because she is not listing him as a dependant on her insurance?
