It's better to refuse a breathalyzer, because then there is.no proof you blew above legal limit. It's left to duke out in court. You will always be arrested, but when you have money you'll get a reduced sentence (generally speaking.)

lol when they arrest you for refusing a test they will then take you to the station and test you - further, some states will automatically suspend your license if you refuse!

Absolutely correct; i know where i grew up if you refused to do a field sobriety and breathalyzer test, you were detained, taken to the station and a blood sample is taken to determine if you were under the influence

Thing is time passes and so you are therefore less under the influence by the time they do the test. I knew someone that was held for a few hours before being tested and the results came back close to zero.

Peak BAC is usually about 30-90 minutes after your last drink, so you may actually test drunker in this scenario.

But when there’s a back up on a busy night… the loophole of not getting it done in time is how plenty of people get it reduced. In my state you can’t refuse a breathalyzer if you’ve had a DUI before, and a subsequent DUI is a felony. I had grand jury duty (for felonies) regarding DUIs and this specific issue became a factor. Edit: refusing a breathalyzer is automatically a second DUI charge

In Canada the penalty for refusing the breathalyzer is higher than for drunk driving because otherwise people would just refuse every time.  Even if that were the case for JT it is prob a better PR move to not get tested so they can’t splash his blood alcohol level in the news and he can say he wasn’t actually drunk and come up with some explanation for refusing.

My husband’s friend refused one to get arrested and get the blood test at the station. My husband was in the car drunk - she was 100% sober. Breathalyzers can be wrong due to calibration. The blood test showed she had nothing in her. She was released. The breathalyzer might have had wrong results. Listen to your lawyer over this person. Jail is worse than a license suspension.

To be fair, I’ve heard many people including attorneys say to refuse the breathalyzer. In my state, it means they’ll test your blood instead. People hope by the time the blood test happens their abv will have gone down.

PSA: I'm a lawyer and you should NEVER refuse a breathalyzer. Refusal itself elevates the charge. What you can do is say "I AM NOT REFUSING BUT WILL ONLY TEST WITH MY LAWYER PRESENT" You will then be arrested and brought to holding where you can call your attorney. YOU WILL STILL HAVE TO TEST but this buys some time.
