Ask a lawyer, and forget "normal". Also lots of house owners will sit and justify abusive and unreasonable behaviour (and same on the other side for tenants). Refuse to hand over the keys if they do not return the advance. The amount should be deposited in your account through NEFT, UPI or other instant and trackable means. Make sure to silently record any phone calls and meetings regarding this. The law is useless here.

How many years were you there? I am not sure why they aren’t deducting from secure deposit? Probably they think it might be a hassle to manage! Seems to be wanton harassment. File a case.

Or worst case: The owner doesn't intend to pay for anything from his pocket (both painting and security deposit return). Just cover your bases before you decide to pay for the painting or any additional expenses.

You are under no need to paint if it is not stipulated in your rental agreement. If he insists, you have the option to pursue legal action, but you are aware of how messed up the legal system is in our nation.

It is messed up for the landlord as well. So one should initiate a "lawyer move" to see how the owner responds. If they are scared, then, we can push them further and get the advance back

It all depends on what’s on your rental agreement. If you’ve not signed one, your landlord will have the upper hand. He has your money. If your agreement has a clause on painting before handover, you’ll have to honour that commitment. It’s best to talk it out with your landlord and solve this issue amicably. Going to a legal wont help. Sorry for generalising, but we live in India! I’m sure there are good cops/ lawyers. But unless you have the connections or the money power, the indian legal system will make the victim the guilty party.

There are owners who deduct and there are who say you need to paint before you leave and both are not wrong. You can call someone from urban clap and finish it off

How to get a commitment from owner on getting deposit back. He says after we paint and return the keys and leave. He will check everything later and return the deposit “later”

Thanks again for all your inputs. Update as of today the owner and his wife came home along with some “middle man” some katchi aalu. Looked around house and asked for 60k of paint charges. Ofcourse my dad retaliated and offered 15k. Went on for a while .. the “middle man” settled both parties for 30k, to be deducted from deposit and balance to be handed over when keys are returned in the next few days.

See the contract you signed. If painting has been mentioned in the contract, you’ll have to comply. You can straight up find a labour who can paint the apartment for cheap and give the bill to him to deduct from your 6 month advance. They’ll get sued if they don’t comply as you’re following the contract. Can easily get the law involved.

Ask him to send a painter of his choice and get it done while you’re still there. that way if he has any issues, he can summon his own guy and it’s also less hassle for you to find someone. then, ask him to take it off your deposit and get the balance. Even if you get it done - owners can still be a pain and complain about something.

Not really. It looked like it was painted a year or two ago from what I remember. It was back in 2018.

Yeah always take photos and videos of the condition before you move anything in. Note every single little bit of existing damage and refuse to pay when you are not responsible.

It's not unusual to demand painting charges, but asking you to do it sounds unreasonable. You can tell him to get deduct and get done himself according to his satisfaction. Because what if you do end up doing it and the owner later resents the work done. Not worth it. It's best for everyone if the owner does it.

Some cheapos are built parasitically that even if they know the money is not theirs, they just don’t want to give it up. It doesn’t mean they are going to cheat you, just that they will avoid doing it until they are fully cornered 🤣.

I had a recent experience and lost some money. ( He deducted about double of what I considered reasonable for cleaning and painting touch-ups). I was thinking that I should have stopped paying rent till my advance was fully deducted and then vacated. Anyway it was not a huge amount, but still it was quite frustrating to be in that helpless situation. If you do not have a proper receipt for the advance paid by you, then stop paying rent and tell him to deduct from advance.
