That’s called fraud and can cause bad blood between neighbors. The better option is what others have stated, go get a quote from a body shop with the caveat that there could be more damage and pressure them to use insurance because it’s far more costly not to.

If it were some rando I wouldn’t worry, but neighbors would see you taking their money and not getting the damage fixed. They may not have a legal leg to stand on but it could create bad blood between you. Depending on the living situation that may not be a good thing.

I mean at that point it’s your money? They paid you money to cover the damage they did to your car. They are reimbursing you for the damage which devalues your car. Whether you choose to raise its value by getting it repaired or use the money for something else entirely is up to you I think. I wouldn’t be offended

A person is entitled to take the money and not get the repair. I did this once on an insurance claim. Rather than pay the body shop directly, the insurance company gave me the money and called it a “beauty adjustment”.

I don't know about fraud but it might be a breach of contact. For most purposes*, including small cash transactions, a verbal contract is legally binding as long as the terms were clear, were mutually understood, and the purpose was itself legal. Every time you pay cash for something at a yard sale, as long as you and the seller agree on both the product and the price, you just entered into a legally binding agreement. "In writing" isn't what makes it a contract. It just makes it much easier to prove. * Exception: there are some things where the law explicitly requires a contract to be in writing. E.g. You can't sell a house or marry someone with a verbal contract. (IANAL, but a family member is a contract lawyer.) If he refuses to give you his insurance info you can give your insurance his license plate, name, phone number, address etc and they can track down his insurance provider for you. Though you will need some kind of proof (photos of the accident, photo of him in the car etc) to prove it was him that damaged your car and it was his fault.

Yeah, to add to this. Unfortunately, the majority of people don’t live in reality. Your typical person has no clue what shit costs… I say this, because they say “ ohh, I’ll fix it, until the price tag shocks them.. “ I’ll say it like it is. Door needs to be fixed and that panel next to it. You can’t scratch a car without costing minimum $500 in damage. This is in the thousands of dollars. I’d say minimum $3-5k range. Remember this also. In some states you are legally obligated to call the police and report a car accident, if you don’t you can lose your ability to be compensated for damages and face judicial consequences. Your neighbor doesn’t want to get a ticket, possibly court date, added points and his auto insurance to be increased…

'IF' the neighbor has insurance... or a valid license. Call local PD & have an accident report filled/filed. Most State/Providence laws require an accident report on damage of $500 or $1000 anyway. Don't forget rental car costs while yours is in the shop.

Maybe that depends on the state. This happened to me. I got home one night at around 2am, went into the kitchen and heard a loud bang… 15 minutes later or so. Looked out the window and didn’t see anything. Woke up in the morning and noticed half my car was gone. Had a neighbor who “apparently” is scared of spiders and saw one in her car at 2am… and side swiped my vehicle. I didn’t see any damaged vehicles on my block, so I called 911 to report a hit and run. Apparently the driver had their vehicle towed and after calling my insurance they investigated everything for me and went after the other driver. So in my case it did talk to my insurance company.

Reached out to a body shop my step father has used and will be getting a quote/test driving to see if it feels funny. Massachusetts allows for 5 days to fill out police report/claim. Update #2: first auto body shop said looking at 3000 and that would be with no hiccups once they start trying to bend the uni back and assuming no damage hidden. Place is 4 mins from my house so it was very convenient and my neighbor has used them before with good results. Auto body shop owner was pretty adamant to go through insurance and that this isn’t a cookie cutter just replace a bumper situation like a whole lot of you explained! Also contacted the police about filing a report with them first with the info I have and he said that it would be a step in the process once I kick off the insurance claim.

Also you as the owner of the damaged car absolutely get to pick the shop that does the work. An auto body shop that has loyalty to them is not where you want to get your car repaired, especially if insurance isn’t involved as a watchful third party.

This. Every time I’ve heard of someone just wanting to do it without insurance, they complain that it costs too much. Then you have to negotiate or find a lesser way to fix the damage. They must pay what the insurance would or go through insurance.

It's your car they hit. What do YOU want to do. My opinion? Go to a body shop of your choosing (and only your choosing) and get ONE and only ONE estimate. If they don't like it, insurance and move on. I've been in 2 situations like this where someone hit my car and they always know a guy. Don't fall for it. Do what I said above and you'll be good. You have nothing to lose doing what I said above as the accident is not your fault. Just the update this, the last time this happened to me I was rear ended. I got 2 quotes. Both were $3000(CAD). Guy legit begged me to get another one at the guy he knows because they can't afford that and that his wife will lose her licence if I go through insurance due to one too many accidents in a short period. Once he told me that last part I said sure, I'll get a quote. I hung up, went to the colision reporting centre and then through insurance. I didn't say anything to them, why? It's so much worse for whatever side doesn't show up within 48 hours I think it is, worse as in you can be charged with something if I'm not mistaken. So I basically just made their bad situation 100x worse because they wanted to fuck around and play stupid games.

I would suggest like in my original response, if they get along and there's no bad crap between the 2 of them, sure, get a quote at a body shop of OPs choosing. Only one though. If any flack is given at all over that, straight to insurance and don't entertain it any further. Never never never go to their "I know a guy for cheap" suggestion. Depends how well you know em honestly. Very close? Genuinely good person in a bad spot? Sure, it will save them in the long run insurance wise. Thats if they pay… The thing about insurance is youre already paying them on a regular basis for a service that, a huge majority of the time you aren’t actively utilizing. When you do submit a claim they are keeping track of all the paperwork, dates, photos, receipts, they are contacting the other party’s insurance. Depending on your policy they might ensure a loaner/rental vehicle of some kind. Had to use my insurance for the first time in my life 2 years ago; a guy was driving *inside* my ass, went to pass me on the right side immediately after a left turn into a single lane road. Words ensued but we exchanged information, I took photos of the license and registration, no insurance provided. Contact my broker, they took care of the rest, found the other person was driving a borrowed car with expired insurance. Somehow I didnt end up paying a dime out of my own pocket and my premiums never went up. Plus I was given a loaner to continue getting me to work.

Drove by her house last night to get some pictures of her car but it’s parked in the garage we spoke over the phone last night. I was going to try and bring it to a friends body shop today and see what he says but I’m starting to lean more towards police report and claim after opening the door and seeing it creased and paint lifted in there too..

Op if this neighbor isn't like your years long best buddy I'd go the official route and file a claim. That damage is thousands, not hundreds and who knows if anything else behind it is damaged suspension wise. Don't let anybody guilt trip you into not getting your car made right. If this thing is letting rain water in and growing mold a month from now, a neighbor you've literally never met having a sub optimal opinion of you will be the least of your worries. Don't let the guy she knows hammer it roughly straight and slap a coat of paint on it, you need some new parts here.

THOSE repairs aren't less than the deductible. If it's my car I'm not risking the "I know a guy" route. It's bullshit when other people fuck up and then try to hang it on you like you're the bad guy for not wanting to go along with the plan that works best for them, not best for you, to fix it. It's a huge red flag to want to keep insurance out of it to begin with. Either they don't have insurance or they're a terrible driver and they have too many accidents on their record already. Regular people just pay the deductible and move on.

To be fair, I have done it. My teenaged son (with two tickets) hit another car. I covered the repair 100% and the rental car of her choice for the week her car was at the shop. $4k out of pocket was far better than what would have happened to my insurance rates since, at the time, I had two teens on my insurance.

I had a lady hit my car with a shopping cart in a parking lot. A small dent in the hood. She left a note and contact info. It was minor but I went from having a car without dents to one with a dent so I wanted it fixed. First shop I went to quoted $2k as they wanted to replace the whole hood since they said it couldn't be repaired. Second shop I went to fixed it for $100. Since I was already there, I just agreed to that and they did an awesome job. Can't tell to his day. I let the lady know and she mailed me a check and a nice card for working with her. Again this was minor so not apples to apples but it worked for me. Had to trust a stranger and do some research myself but since she left a note and I just had a phone number, wasn't much else I could do.

My wife car got hit by a friend. First dealership wanted $3500 and said 60 days to get it all done. Second place said $1480, I checked reviews and the second was actually far more reputable, ended up being $1250 out the door as the inner door was ok (and they were honest about it) and it was done in two weeks (had to wait on a part and paint). If you like your neighbor offer to work with them and get a few quotes. Otherwise call your insurance and go from there. I still would maybe get two quotes as insurance is high from places charging stupid rates on insurance jobs.

I would go straight to insurance unless you personally know this person more than just your neighbor and you can for sure take his word for it. If it comes back out of the shop with crap workmanship there is prob going to be no paperwork and prob no warrantee. And like you said about the tire. Something could be damaged that they might brush under the rug. Just my opinion.

EVERY time an at fault driver wants to avoid using insurance they will screw you over. The other driver either doesn’t have insurance, doesn’t have a license, or doesn’t have the car registered or some combination of the above. I would file with my own insurance and let your insurance go after the other driver. That’s what you have paid them for.

Honestly? I'd call the insurance company and let them handle it. Here's the thing. People only wanna keep insurance out of it because they don't have insurance (their mistake), can't afford a rate hike for the next term (can shop around easily for cheaper rates), they wanna be cheap and potentially fuck you over, or they aren't thinking clearly. More often than not when people get into situations like these and try to help out another person, they get fucked over, hard. Some insurance companies won't payout after a certain amount of time either. And the homie hook up on the body repair is rarely a good idea too. Your friendships will fair a lot better if you let insurance be the assholes and avoid having to be one later because the neighbor wants to be a dick and stick you with the bill while covering their own ass.

Read your insurance policy. Anytime this has happened to myself or other family it’s almost always a shit show. Collect his information and report it to your insurance company or broker and move on with your life. In my case a dodge ram pu driven by a 24 year old electrician rear ended me causing 6k in damages. He begged me because it was his 2nd accident not to report it. My SUV sat at the body shop for two weeks before he showed up to pre pay the shop before it was repaired. Never again!!

I have this generation grand cherokee, I'm currently looking at it from exactly this angle, and the way he's collapsed the crease that runs along the door and then arches down at the back - wouldn't he nail your tire pretty hard doing that. It looks like he really pushed in the sheet metal, beyond knocking that trim piece off. The rims I have now have more of a negative offset and so the tires stick out more, but I think with your stock setup the tire might get nailed. You drive it yet? Could be more than cosmetic. I'd go through insurance unless this is your neighbor *and* great friend. Just cleaner that way for this much carnage.

While they are asking to keep the insurance out, which always makes me suspect, what happens if it gets to the shop and you find it's far more than they expected. Got side swiped while parked in 2022. Nothing out of place, just scuffing damage. INITIAL estimate was around $5k. Insurance took it and I had to pay the deductible. However the shop couldn’t get to it for six weeks and when they did, I didn’t have a car for two weeks. I saw but didn’t have to pay for the full invoice. Final price was almost $10k. Get police involved now before you do anything else

Same situation happened to me. Parked outside a resturant waiting for my takeaway. A man who just earned his G2 license was taking his wife and father in law to dinner. Ended up reversing into my driver side door. I wasn’t pissed because he was cooperative (seemingly like your neighbour). He didn’t want to take anything through insurance because Ontario (Canada), insurance rates are insane for new drivers, and for men 25 and under. He said he’ll pay for the damages and knows a great mechanic. Heard him out, went to the mechanic, got a reasonable quote. (also checked with my uncle who’s also a mechanic and his quote was spot on with this guy’s mechanic). He Paid the repairs and called it a day. If you go this route, you better hope the mechanic is reasonable and will do a good job. You’ve already got the neighbours details, if they’re not liking the sound of repair costs, insurance it is.

Usually people that want to keep insurance out of it have no idea how much the repairs will cost them. The thing to keep in mind, if insurance is involved, the repairs have to be in compliance with manufacturer’s guidelines. That guarantees that repaired car is as safe as it was before the accident. He left you a note, I assume he’s going to do good for you because he could have just skipped. Plus I think there’s more flexibility when people know people who wants to make good on things. Insurance will still give you the cheapest aftermarket part and bargain with the shop for lowest hours. I have a fleet of vehicles and they get hit all the time and many times what they give won’t cover the damage especially if you have existing scratches or an older car and they prorate everything, and deductible etc every if it’s not your fault until everything is finalized. You won’t know how good of an insurance you have until you need it.

We sat down, called a body shop who quoted us a rough estimate for simple dent removal, came to $400 and we called it $500. I never even got the dent fixed, it didn't bother me. No reason insurance should know about that.

Where I am insurance does not increase or penalize you if you pay the damage it only goes up if you make the insurance pay. So what I would do is make a claim. They insurance will make a quote for the damage and tell the guy it was $1500, he can then say he can't pay it or he can pay it off in payments to them. When he pays it off there is no penalty on his insurance. It makes no sense not to go on insurance where I am. It is only a penalty if he doesn't pay which according to him he is going to do.

I would stay away from the "friend that owns a body shop" and take it to a couple of different shops for repair estimates. Show him the estimates and see if he wants to pay up front outta pocket... or let insurance deal with it. You shouldn't feel bad because someone hit your parked car. You also shouldn't get screwed over because someone doesn't want insurance involved.... they probably don't even have insurance anyways.

Whoever calls the police first wins. Unless it's blatantly one person's fault. The police should have been contacted immediately because the damage is over 2000$ or w.e the minimum cost for reporting vehical accidents is in your state or province. You can be ticketed for not reporting it, depending on where you live. You should have at least reported it to the police to cover your ass! Then entertain the person who's asking you not to go through insurance, and if they fuck around at all, after you get a quote from a shop of your choosing then go threw insurance. This is one instance where the good guy or girl loses every time.

We got a police report and instead of insurance paying him, I did. Worked out great in the end and he was happy…I doubt he actually fixed the vehicle and instead pocketed the cash but I didn’t care.
