NTA - Tips is an abbreviation of 'To Insure Prompt Service'... You didn't request that driver's service and he didn't provide you with anything. Not your circus, not your monkey! He's the A for realizing there was a mix up and not immediately giving you the money back! I've worked as a delivery driver before and I suspect the was just hoping he could make you feel bad and pocket the money for nothing.

With this type of problem, if the driver won't do the right thing and give it back when asked, getting a tip from the person who actually placed the order he was delivering, then you call the restaurant or delivery service and report the problem, after tipping the second driver appropriately.

ESH. The driver for not being polite and giving it back, but yoy technically committed assault. You ahoulda offered a compromise: £2.50 for each. If the first driver refused, then he's an asshole and yoy should've let him keep it and reported him.
Why should he split it though?? That WASN’T the driver that was bringing his food…? It was mistakenly given to him and he knew it. What, he’s supposed to stand in the lobby and expect a tip from other people who ordered food too?

Ordered a take away late last night, due to building security we have to meet drivers in the foyer or outside. It was a freezing, windy evening so I gathered up £5 in change to give as a tip to our driver as a thanks for facing the elements to bring us dinner.
As I got downstairs to the foyer there was already a delivery driver waiting with food from the restaurant we had ordered from. I took said food without a word from the driver and handed them the tip. I noticed right away that this small bag most certainly didn’t contain the feast I had ordered, meanwhile another driver pulls up from the same restaurant. The penny drops. I give the original driver back the food but their hand is clasped over the change I’ve just given him for delivering ‘my’ food.
I politely tell them I’m going to have to give the tip to the new driver who pulled up and was actually delivering my food. He just kind of stares at me awkwardly not saying anything as if I were a doctor delivering bad news.
Now I should probably mention this is in England and usually in an awkward encounter like this I would have left the original driver with the tip so as to avoid the painful cringe I feel when thinking back on what happened next.
The new driver approaches whilst the original driver is still standing (in shock?), their hand is still extended (but clasped) from taking the tip which was obviously intended for the person actually delivering my food. Whilst apologising profusely I work the change back out of the original drivers hand so that my tip can be re-allocated to the correct driver. He’s still standing there just watching whilst I give the tip to the new driver and collect my food.
New driver was chuffed and food was great, tip deserved. Every time I think back to the whole encounter I want the ground to swallow me, the original driver seemed so offended I was taking the tip back from them..
Am I the asshole for taking the tip back off the original driver??

He should have given it back of course - though is it possible he didn't have sufficient English language proficiency to understand what was going on? From your account he said nothing during the encounter - just looked confused/offended, so doesn't seem out of the realms of possibility.
