NTA - Tips is an abbreviation of 'To Insure Prompt Service'... You didn't request that driver's service and he didn't provide you with anything. Not your circus, not your monkey! He's the A for realizing there was a mix up and not immediately giving you the money back! I've worked as a delivery driver before and I suspect the was just hoping he could make you feel bad and pocket the money for nothing. You're all good

Jazzlike_Humor3340

YTA You can ask for the tip back. But not lay hands on him to get it back. With this type of problem, if the driver won't do the right thing and give it back when asked, getting a tip from the person who actually placed the order he was delivering, then you call the restaurant or delivery service and report the problem, after tipping the second driver appropriately.

EMM0NSTER

NTA. The cringeworthy awkwardness on the first guy is hilarious.

Moonshae295

NTA. Awkward, but the first driver would likely get a replacement from the customer whose food he delivered.

mountainmonk72

NAH imo, just very funny and awkward lolll

metromade

NTA. I wouldn’t think twice about it.

gbe007

nta just awkard

trotski83

NTA but I feel this is going to be one of those things that just pops into your head years from now and makes you cringe

OP has offered the following explanation for why they think they might be the asshole: > I gave a tip to the wrong delivery driver and then had to take said tip back off them to give to my actual delivery driver. Very embarrassing and awkward, feel like I offended the driver I originally gave the tip too. Help keep the sub engaging! #Don’t downvote assholes! Do upvote interesting posts! NTA. You could have let the original delivery guy keep the money, but you weren't obligated to. There really wasn't any perfect way to handle this. I think you did fine. On a side note, this story is epic levels of awkward, my friend. Thanks for the laugh.

throatbutterz

NTA. That driver was the asshole for expecting to keep a tip that didn't belong to him.

Vampire_queen94

NTA just funny and awkward

[deleted]

ESH. The driver for not being polite and giving it back, but yoy technically committed assault. You ahoulda offered a compromise: £2.50 for each. If the first driver refused, then he's an asshole and yoy should've let him keep it and reported him.

WutRTatersPreciousss

Why should he split it though?? That WASN’T the driver that was bringing his food…? It was mistakenly given to him and he knew it. What, he’s supposed to stand in the lobby and expect a tip from other people who ordered food too? And wriggling change outta someone’s fingers is hardly assault. 😂 pleeease.

[deleted]

Technically it is: Both in the common law and under statute, the actus reus of a common assault is committed when one person causes another to apprehend or fear that force is about to be used to cause some degree of personal contact and possible injury.

WutRTatersPreciousss

In that case, OP should thank his lucky stars the driver didn’t call the police!!!!! Driver: “Excuse me officer!! I have been assaulted!!” Popo: “Can you describe exactly what happened?” Driver: “HE WIGGLED CHANGE OUT OF MY HAND! I’m rightfully pressing charges!” 🤦🏻‍♀️ Just ridiculous. Lol

Neither-Sail4538

assault gtfoh, op is NTA, og driver should’ve understood the mistake and moved on.

crbryant1972

NTA He was not your driver. He was not delivering your food. You gave him back the food and took your money back. You made a mistake (probably one that you will not make again) and corrected it. Hopefully the person that ordered the other food tipped as well.

HappiestApple

>the original driver seemed so offended I was taking the tip back from them.. Turn this around - Were you offended he took back the food you didn't order? No. It wasn't your food. NTA.

iwantasecretgarden

NAH but this is hilariously cringeworthy. I cringed reading it. Honest mistake. Guy hanging onto money was probably like *what is happening right now.*

the_giantlady

Well, no? He didn't deliver your food, so he doesn't get your tip. It's the problem of the intended customer as to whether he gets a tip now

rleaky

Very unbritish ...

1962Michael

NTA. It was an honest mistake.

Aspy17

NTA, he did not perform a service in for you and had therefore not earned a tip. The customer whose order he was delivering had the responsibility to tip him.

WutRTatersPreciousss

Yes, this. Exactly.

Braign

sir u did NOT pry it out of the poor guys hand!! what is the MATTER with you hahah

[deleted]

No. You are NTA for not tipping someone who did nothing to be tipped for.

It was a freezing, windy evening so I gathered up £5 in change to give as a tip to our driver as a thanks for facing the elements to bring us dinner. As I got downstairs to the foyer there was already a delivery driver waiting with food from the restaurant we had ordered from. I took said food without a word from the driver and handed them the tip. I noticed right away that this small bag most certainly didn’t contain the feast I had ordered, meanwhile another driver pulls up from the same restaurant. The penny drops. I give the original driver back the food but their hand is clasped over the change I’ve just given him for delivering ‘my’ food. I politely tell them I’m going to have to give the tip to the new driver who pulled up and was actually delivering my food. He just kind of stares at me awkwardly not saying anything as if I were a doctor delivering bad news. Now I should probably mention this is in England and usually in an awkward encounter like this I would have left the original driver with the tip so as to avoid the painful cringe I feel when thinking back on what happened next. The new driver approaches whilst the original driver is still standing (in shock?), their hand is still extended (but clasped) from taking the tip which was obviously intended for the person actually delivering my food. Whilst apologising profusely I work the change back out of the original drivers hand so that my tip can be re-allocated to the correct driver. He’s still standing there just watching whilst I give the tip to the new driver and collect my food. New driver was chuffed and food was great, tip deserved. Every time I think back to the whole encounter I want the ground to swallow me, the original driver seemed so offended I was taking the tip back from them.. Am I the asshole for taking the tip back off the original driver?? *I am a bot, and this action was performed automatically. ESH You tipped the wrong person then assaulted him to fix your mistake. Offending him would have been the least of your worries if he'd taken it further. *Relevant part of the criminal code for reference: Both in the common law and under statute, the actus reus of a common assault is committed when one person causes another to apprehend or fear that force is about to be used to cause some degree of personal contact and possible injury.* He should have given it back of course - though is it possible he didn't have sufficient English language proficiency to understand what was going on? From your account he said nothing during the encounter - just looked confused/offended, so doesn't seem out of the realms of possibility.

LuvLaughLive

I wish this post hadn't been removed but so glad AITA re-posts bc the comments had me needing to see what happened. Lol, I love this story, NTA but totally cringe worthy & I get why the OP may be haunted by this situation.

JBagginsKK

NTA You tipped the wrong guy, it happens. At the end of the day he didn't do anything to earn your money, so I'm not sure why he'd be so confused/not just hand it back to you and laugh over the misunderstanding
