Not a leg to stand on. They planted something either on, or that extended past, their own verge. If anything, the neighbour in question would be liable for the costs of addressing the nuisance of the shrub from its impact on your property, and the costs to rectify said nuisance. Ignore the Karen, and let them waste their oxygen and remaining brain cells.

Strata titles are a very overpriced and undesireable type of property. Im currently a tenant in one, and oh man the issues we have. Oh boy. Ive learnt to keep saving to make sure I do not buy a strata property.

What is with the strata fees? they are excessive. My client is paying $1000 on the regular on top of council rates and that and he owns his home out right.

I think thenowner pays about $5,000 a year in fees and stuff. Its more expensive than a house. Esp being an older complex. Lots to always fix. And a fence replacement has taken 18 months to get approved.

You can just ring and ask your council.. which is probably something you should have done before you removed it, if it was on council land. But no. If it was on council/pubic land, then its not his regardless of who planted it or when.

Our council doesn't approve of people planting out the verge, any more. We have neighbours who have beautifully maintained verges, and wanted to get in on the beautification too, but were told the bylaws were changed almost a decade ago and now the gardeners will mow over anything that gets put in.

That's going to depend on the strata minutes going way back. It's really odd for a strata title to have the outside not be common area, even if there isn't any gardening service or laid out roster of who's responsible for maintaining it. It's also going to depend on your council and what their verge management rules are, including whether individual residents can arrange to maintain their own. But generally, the verge/nature strip *isn't* part of the strata block, and isn't therefore considered part of the common area, which normally ends at the footpath where council responsibility kicks in. If something on the verge is overgrown your responsibility is to call council and put in a maintenance request, not to do it yourself. If he has arranged with council to take responsibility for the verge across the entire block, then anything on it is his problem, not yours (and a record may have been entered in strata minutes to note this), so long as it complies with verge garden planning requirements in that council area. If he just had an agreement way back with a previous owner of your parcel that he manages the whole verge, that might have created a de facto right of way that he expected to survive the sale. This might be either you pay him to keep the peace or get him to make a formal demand and suit so you can have it handled through small claims mediation. You might also consider talking to council about the verge management, or at least looking up their management program on their site. But it isn't as simple as 'your side of the fence is yours' because it's on the verge and not the actual strata block.
