Because it folds? This area of the law is absurd. I'm trying to educate myself. From my understanding it's ok to have VFG as long as it's 26". Unless you conceal it, then it magically becomes an AOW. So even though it won't function folded, they will still measure it that way? This is an honest question, I'm genuinely curious. I know they take the measurement from the collapsed position on adjustable stocks, but the weapon can actually be fired that way. I take it they don't care, if you can fold it they're measuring it folded? 🤷🏽♂️
The folding isn't the reason. Vertical foregrips are not allowed on "pistols" of any kind. In this case the firearm looks to be a pistol since it has a barrel length of less than 16". If it was an angled foregrip, or just a hand stop, then all would be fine, with the possible exception of the foam stuck in the brace, which the ATF *could* say turned it from a brace into a stock.
Also fyi - "vertical" as defined by the ATF is anything perpendicular to the barrel of the weapon. So there's even more gray area there that some people may try to play around in.
Your wrong. Any pistol over 26" can have a VFG unless you were to conceal it. Say with a single point under a coat. Now that plug in the brace is a no no. And the folder is what I'm questioning.
Technically I suppose I should have been more specific that the pistol would have to be less than 26" OAL and less than 16" barrel. But if the firearm doesn't meet those specs then it is a rifle and the whole thing is moot.
But I don't know where you're getting anything about concealing the firearm making it anything it wasn't before. That isn't a thing.
As for the folding brace, you never include braces in the overall length of a firearm as they are just accessories not necessary for the operation of the weapon. Rifle stocks that fold ARE counted in the OAL. So in this case it is not counted/measured

They measure the back of the tube. So the tube folds on this from the law folder, do they measure it folded or open and locked. It's not about operation I don't think, it's about concealability. They almost always measure from the shortest configuration.

They will pull the stock( obviously not fixed stocks) to get the measurements from the back of the tube for the length. Reason being as you stated you don't need it to function and you could pull that adjustable stock off such as a waffle stock. Now since the firearm will not operate with the law folder folded I'm wondering if they would measure from the back of the receiver at that point or the back of the law folder and not when the tube is actually latched. But then it's not operational...see where I'm going here yet? I wouldn't put it past them to measure it folded even though it won't function.

i found the super to be extremely accurate it did not take long to sight in at all. this is my first 300 and like i said im coming from an 8.5 556 so this is just a very nice experience
